Regular City Council Meeting <br />February 9, 2004 <br />Page 23 <br /> <br />legal implications of that issue. <br /> <br />Mayor Fendley asked if an appeal could be made to the Attorney General. City <br />Attorney Schenk thought the answer would be that we already have an <br />outstanding court opinion. He thought the best way to address the issue would <br />be to effect a Charter change, so it will state that the City would abide by the <br />Open Meetings Act. City Manager Malone reminded everyone there was an <br />election on that issue and it failed. <br /> <br />Councilman Bell asked if it was too late to put Charter issues on the ballot for <br />the May election. City Attorney Schenk indicated it was too late. <br />Councilwoman Neeley said the City did have an election on the issue and it was <br />voted down. <br /> <br />Councilman Bell remembered there were several issues on the Charter that <br />failed during that election. He asked if the Charter was written in 1948. City <br />Manager Malone said it was written in 1948 by a committee with Hardy Moore <br />as the attorney. City Attorney Schenk observed that makes the City Charter pre- <br />date the Open Meetings Act by twenty (20) years. <br /> <br />Mayor Fendley reminded the Council the drafts of the new Evaluation forms <br />would be gotten out so everyone can look at them. He continued, once they <br />have been examined, if there is something which needs to be changed, they will <br />have another meeting. He asked if a resolution would have to be passed to <br />adopt the Evaluation Forms. City Attorney Schenk answered in the affirmative <br />and mentioned that it could done at the same meeting as the evaluations were <br />presented, prior to the presentation. <br /> <br />Councilwoman Neeley wanted the time line clarified for verifying the drafts and <br />presenting the evaluations. Mayor Fendley said the forms would be drafted and <br />gotten out, make any corrections, pass the resolution at the next meeting and <br />bring the completed evaluations in March. <br /> <br />Councilwoman Neeley reminded the Council members if they wanted their form <br />included in the Evaluation, they must be present at the meeting. <br /> <br /> <br />
