A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT WITH HAYTER ENGINEERING FOR CONSTRUCTION ENGINEERING SERVICES ASSOCIATED WITH THE HERITAGE PARK PAVING AND DRAINAGE IMPROVEMENTS PROJECT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 14th day of October, 2002, in Resolution No. 2002-164, authorize the execution of a Lease Agreement with the Chamber of Commerce of Lamar County for use of the Paris Santa Fe-Frisco Railroad Depot property; and, WHEREAS, as part of said Lease Agreement, the City of Paris agreed to construct a parking lot on a portion of the Paris Santa Fe-Frisco Depot property to be used jointly by the Chamber and by patrons of Heritage Park, with the Chamber agreeing to be responsible, at its sole cost and expense, for any and all necessary maintenance, repairs, improvements, and upkeep of said parking lot; and, WHEREAS, it is deemed appropriate that the City execute an engineering services agreement with Hayter Engineering for the Heritage Park Paving and Drainage Improvements Proj ect, under the terms and conditions and in a form approved by the City Attorney; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the Mayor be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, an engineering services agreement with Hayter Engineering for the Heritage Park Paving and Drainage Improvements Proj ect, under the terms and conditions and in a form approved by the City Attorney. Section 3. That this resolution shall be effective from and after its date of passage.
