DRAFT F:\Attorney\ALICE\RESWORK\CURRENT\Sports Complex Contract #2 - Change Order No. 1.wpd April 8, 2004 RESOLUTION NO. _______________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING CHANGE ORDER NO. ONE TO CONTRACT #2 WITH RICHARD DRAKE CONSTRUCTION FOR SOFTBALL FIELD FENCING INCLUDING CHAIN LINK FENCING, BACKSTOP AND DUGOUTS FOR THE PARIS SPORTS COMPLEX; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, on the 8th day of May, 2003, in Resolution No. 2003-080, award Contract #2 for softball field fencing including chain link fencing, backstop and dugouts for the "Paris Sports Complex," to Richard Drake Construction; and, WHEREAS, MHS Planning & Design, acting as project engineer, recommends the amendment of the contract for said project by Change Order No. One, to install six 2" x 2" steel columns at each dugout to create better fence to column connections at each dugout (8 dugouts @ +$600 each), and to substitute pine decking on the dugout roof in lieu of pressure treated pine increase (8 @ -$65 each), and providing for a net of $4,280.00 in the contract price, for a total contract price of $126,011.66; and, WHEREAS, the form of Change Order No. One, attachedhereto as Exhibit A should, NOW, in all things, be approved, and the Mayor should be authorized to execute the same; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this resolution are hereby in all things approved. Section 2. That the form of Change Order No. One to Contract #2 with Richard Drake Construction for softball field fencing, including chain link fencing, backstops, and dugouts for "The Paris Sports Complex," attached hereto as Exhibit A, to install six 2" x 2" steel columns at each dugout to create better fence to column connections at each dugout (8 dugouts @ +$600 each), and to substitute pine decking on the dugout roof in lieu of pressure treated pine (8 @ - increase $65 each), and providing for a net of $4,280.00 in the contract price, for a total contract price of $126,011.66, be, and the same is hereby, approved.
