Motion carried, 6 ayes — 0 nays. <br />14. Convene into Executive Session: <br />• Pursuant to Section 551.072 of the Texas Government Code, to deliberate the <br />purchase, exchange, lease, or value of real property. <br />• Pursuant to Section 551.071 of the Texas Government Code, Consultation with <br />Attorney to receive legal advice from the City Attorney about pending or <br />contemplated litigation and /or on matters in which the duty of an attorney to his <br />client under the Texas Disciplinary Rules of Professional Conduct of the State Bar <br />of Texas, clearly conflict with this chapter, as follows: Boomer Trends Magazine <br />vs. City of Paris. <br />• Pursuant to Section 551.074 of the Texas Government Code of the Texas <br />Government Code to deliberate the appointment, employment, evaluation, <br />reassignment, duties, discipline, or dismissal of a public officer or employee, as <br />follows: city attorney. <br />Mayor Pro -Tem Grossnickle convened City Council into executive session at 7:35 p.m. <br />15. Reconvene into Open Session and possibly take action on those matters discussed in <br />Executive Session. <br />Mayor Pro -Tem Grossnickle reconvened City Council into open session at 9:03 p.m. <br />Mayor Pro -Tem Grossnickle said Council received an update on the Boomer Trends <br />lawsuit and that the City won the lawsuit. He said the Building and Standards Order of <br />Demolition dealing with the building at 260 S. Main stood. Mr. McIlyar added the Plaintiff had <br />filed a motion for new trial and the City expected a ruling within thirty days. <br />Mayor Pro-Tern Grossnickle said the City Attorney requested that he be recused from <br />representing the PEDC while the outside investigation continued. Mayor Pro -Tem Grossnickle <br />said Mr. McIlyar will continue to represent the City. A Motion to recuse the City Attorney <br />during the investigation of PEDC, was made by Council Member Hashmi and seconded by <br />Council Member Lancaster. Motion carried, 6 ayes — 0 nays. <br />16. Discuss and act on RESOLUTION NO. 2014 -022: A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS, AUTHORIZING A CONTRACT FOR <br />THE ACQUISITION OF REAL PROPERTY; TO APPROVE A CONVEYANCE OF <br />REAL PROPERTY TO THE TAXING UNITS IN PAYMENT OF ALL TAXES <br />(INCLUDING ANY DELINQUENT TAX, PENALTY AND INTEREST) ASSESSED <br />AGAINST THE REAL PROPERTY AS AUTHORIZED BY TEXAS PROPERTY TAX <br />CODE SECTION 31.061; TO APPROVE THE PRIVATE RE -SALE OF THE <br />
