<br />RULES OF THE CITY OF PARIS BOARD OF ADJUSTMENT <br /> <br />1. <br /> <br />Meetings of the Board may be held at the call of the Chairman or at such other times as <br />the Board may determine and in accordance with the Open Meetings Law. <br /> <br />2. <br /> <br />The Chairman or, in his or her absence, the acting chairman may administer oaths and <br />compel the attendance of witnesses. <br /> <br />3. <br /> <br />The cases will be taken in the order listed on the agenda, unless in the discretion of the <br />Chairman or person conducting the meeting a case may be taken out of order for good <br />reason. <br /> <br />4. <br /> <br />The applicant property owner shall first make his or her presentation to the Board. City <br />staff shall then follow with any comment or information as necessary. If further <br />information or clarification is desired by the Board, the Board shall request further <br />information or clarification. At the end of the presentations by the property owner, and <br />the City staff, the Board may entertain comment from the general public regarding the <br />request. At the conclusion of the hearing, and after deliberation by the Board and upon <br />motion made, seconded and passed, the Board shall make written findings of fact and shall <br />enter its written orders. <br /> <br />5. <br /> <br />The Board has the right to limit the time given to each speaker and to require that a <br />presentation or comments not be repetitive. <br /> <br />6. <br /> <br />Any interested party or member of the public may appear before the Board in person or <br />by agent or by attorney. The burden of proof shall be on the applicant to establish the <br />necessary facts to warrant favorable action of the Board on any matter. <br /> <br />7. <br /> <br />All comments made by any person to appear before the Board shall be made to the Board <br />and not to another party. The Chairman shall maintain proper decorum for conduct of the <br />meeting. <br /> <br />8. <br /> <br />The Board shall keep minutes of its proceedings, showing the vote of each member upon <br />each question or, if absent or failing to vote, indicating such fact, and shall keep a record <br />of its examination and other official actions, all of which shall be immediately filed in the <br />office of the Board and shall be a public record. <br /> <br />9. <br /> <br />In the event less than five (5) regular voting members shall be in attendance, the Chairman <br />shall designate, at the beginning of the meeting, one or both alternates to participate as <br />voting members; provided, however, the number of voting members shall not exceed five <br />(5). Alternate members not participating as voting members shall still be entitled to <br />participate fully in the deliberative process. <br />
