RESOLUTION 2014 -036 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING CHANGE ORDER NO. 1 TO THE CONTRACT WITH B. BRAY CONSTRUCTION CO., INC. FOR THE PHASE II WATER SYSTEM REPLACEMENT PROJECT AND AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF THIRTY FIVE THOUSAND TWO HUNDRED SEVENTY -ONE DOLLARS AND 07/100 ($35,271.07) TO B. BRAY CONSTRUCTION CO., INC.; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on December 18, 2013 the City of Paris entered into TWDB Contract #62525 CID 002 for the construction of Phase II Water System Replacement with B. Bray Construction Co., Inc. of Paris, Texas; and WHEREAS, on October 10, 2014, the City of Paris staff and consulting Engineer, Hayter Engineering, Inc., certified that the work of the contract was complete and ready for final payment and that it was completed in conformance with the contract documents, plans, specifications, and Change Order No. 1 and Final; and WHEREAS, the construction contractor, B. Bray Construction Co., Inc. of Paris, Texas has certified that they have met all contractual obligations; and WHEREAS, the one -year warranty begins on November 11, 2014 and ends at midnight on November 10, 2015 as provided in the provisions of the contract documents, and WHEREAS, the final contract amount is Seven Hundred Five Thousand Four Hundred Twenty -One Dollars and 50/100 ($705,421.50) after change order and reconciliation of final quantities, and WHEREAS, the remaining amount due B. Bray Construction Co., Inc. is ready for final payment upon the City of Paris' receipt of funds and approvals from the Texas Water Development Board in the amount of Thirty Five Thousand Two Hundred Seventy -One Dollars and 07/100 ($35,271.07). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council of the City of Paris hereby approves Change Order No. 1 and authorizes close out and final payment in the amount of Thirty Five Thousand Two Hundred Seventy -One dollars and 07/100 ($35,271.07) to B. Bray Construction Co., Inc. for Phase II of the TWDB Contract #62525 CID 002 water line replacement project.
