Avigation Easement Dedication Requirements <br />Dedication of an avigation easement should be required as a condition for approval of any proposed <br />development situated within the airport property or in the area of the airport. <br />g. Overflight Including g oise: <br />Policy Objective: Noise from individual operations, especially by comparatively loud aircraft, can <br />be intrusive and annoying in locations beyond the limits of the mapped noise contours. Sensitivity <br />to aircraft overflights varies from one person to another. The purpose of overflight compatibility <br />policies is to help notify people about the presence of overflights near airports so that they can <br />make more informed decisions regarding acquisition or lease of property in the affected <br />areas. Overflight compatibility is particularly important with regard to residential land uses. <br />At times, noise is considered to be the key factor affecting or limiting airport operations, since it is <br />the impact most often noticed by individuals living near an airport. Aircraft operations can create <br />sound levels that produce annoyance in communities near airports, as well as affect speech, sleep, <br />and classroom learning. These annoyances are of concern as they affect the quality of life for <br />residents near an airport. <br />Where disclosure is required, the following statement could be provided: <br />NOTICE OF AIRPORT IN VICINITY: This property is presently located in the vicinity of an <br />airport, within what is known as an airport influence area. For that reason, the property may be <br />subject to some of the annoyances or inconveniences associated with proximity to airport <br />operations (for example: noise, vibration, or odors). Individual sensitivities to those annoyances can <br />vary from person to person. You may wish to consider what airport annoyances, if any, are <br />associated with the property before you complete your purchase and determine whether they are <br />acceptable to you. <br />h. Avigation Easement Dedication <br />As a condition for approval of projects requiring avigation easements, the property owner shall be <br />required to dedicate an avigation easement to the Cox Field Airport Owner, i.e., the City of Paris, <br />TX. <br />The avigation easement shall: <br />i. Provide the right of flight in the airspace above the property; <br />ii. Allow the generation of noise and other impacts associated with aircraft overflight; <br />10 <br />
