(C) REPAIRS AND MAINTENANCE <br />Ordinary repairs and normal maintenance required to keep nonconforming uses, <br />structures, and trees in a safe condition shall be permitted. All ordinary repair and <br />normal maintenance shall be subject to this Section's limitations regarding expansion <br />and enlargement of the nonconforming structure or use. <br />(D) ENLARGEMENT OR EXPANSION <br />(1) Nonconforming Uses <br />a. Structure Enlargement. <br />A structure or portion thereof devoted to a nonconforming use shall not be <br />enlarged, extended, constructed, reconstructed, moved, or structurally altered <br />except to change the use of the structure to one permitted in the applicable <br />zone(s) within the Cox Field Planned Development Airport Zoning District <br />Ordinance. <br />b. Expansion of Nonconforming Uses <br />1. A nonconforming use shall not be extended to any land or portion of <br />property outside of any building that was not used for the nonconforming <br />use when the use was legally established, except when such extension is <br />the direct result of an intervening government action. <br />2. A nonconforming use may be enlarged, expanded, or extended to occupy <br />any parts of the building housing such use that were designed or arranged <br />for such use when the use was legally established. However, if such <br />enlargement, expansion, or extension will result in an increased impact, <br />the Board of Adjustment shall review the request according to the <br />procedures stated in Section 12, Variances. In no case, however, shall the <br />enlargement or expansion result in violation of the performance standards <br />stated in Section 6(C)(3) of this Ordinance. For purposes of this provision, <br />"increased impact" occurs when: <br />a. The expanded use will result in an increase in site population per acre <br />that is either: <br />i. Five percent or greater than the site population per acre that existed <br />when the use was legally established; or <br />ii. Greater than the site population per acre permitted under Section 6 <br />(I) of this Ordinance. <br />b. The expanded use will operate in a different manner, in areas such as <br />hours of operation or number of employees. <br />The Planning Manager shall make all determinations of "increased <br />impact," subject to the Appeals procedure in Section 15 of this <br />Ordinance. <br />3. The Board of Adjustment may approve an expansion request only if the <br />expansion satisfies the following criteria: <br />36 <br />
