XX. Variance. <br />Any modification or variation of this Ordinance's provisions where it is determined that, because of <br />exceptional circumstances, the strict enforcement of the Ordinance provision(s) would cause "practical <br />difficulty or unnecessary hardship," as defined in this Section 19. <br />YY. Vehicle Parking Associated with the Airport. <br />The temporary storage of motor vehicles inside or outside of a structure, including parking lots, garages, <br />driveways, and legally designated areas of public streets. "Associated with," for the purposes of this <br />definition, means that a minimum of 75 percent of the available parking shall serve airport employees, <br />patrons, or automobile rental or leasing agencies. <br />ZZ. Vehicle Parking, Accessory. <br />A non - commercial parking lot or structure that is incidental and subordinate to an allowed primary use, <br />and is intended to serve employees and patrons of the primary use. <br />AAA. Vehicle Parking, Primary. <br />A parking lot or structure that is the primary use of the property on which it is located, and may be <br />commercial in nature. The use does not include parking for an automobile rental or leasing agency use. <br />BBB. Water Impoundment. <br />Areas constructed or intended to contain water such as wastewater treatment settling ponds, surface <br />mining ponds, detention and retention ponds, artificial lakes and ponds, and similar water features. A <br />new water impoundment includes an expansion of an existing water impoundment except where such <br />expansion was previously authorized by land use action approved prior to the effective date of this <br />Ordinance. <br />CCC. Wildlife Attractants. <br />Any human -made structure, land -use practice, or human -made or natural geographic that can attract or <br />sustain hazardous wildlife within the landing or departure airspace or the airport's air operations area. <br />These attractants include, but are not limited to, architectural features, landscaping, waste disposal sites, <br />wastewater treatment facilities, agricultural or aquaculture activities, surface mining, or wetlands. <br />Naturally occurring features such as open bodies of water, wetlands, or forested areas may also be defined <br />as wildlife attractants, which can attract or sustain hazardous wildlife within the landing or departure <br />airspace or the airport's air operations area. <br />DDD. Wildlife Hazards. (FAA Advisory Circular 150/5200 -33A) <br />Species of wildlife (birds, mammals, reptiles, etc.), including feral animals and domesticated animals, that <br />are associated with aircraft strike problems, are capable of causing structural damage to airport facilities, <br />or act as attractants to other wildlife that pose a strike hazard. <br />SECTION 20: EFFECTIVE DATE <br />This ordinance shall take effect on the day of 52014. <br />Copies thereof shall be filed with applicable local, state, and/or Federal agencies. <br />Passed and adopted after public hearing by the Paris, Texas, City Council on this <br />day of <br />50 <br />14. <br />
