MINUTES OF THE STREET & DRAINAGE <br />COMMITTEE MEETING OF THE CITY COUNCIL <br />January 21, 1987 <br />The Street and Drainage Committee of the City Council of the City of <br />Paris met in Special session, Wednesday, January 21, 1987, 5:15 P. M., <br />Council Rim, City Hall. Chairman Mike Folmar called the meeting to <br />order with the following Councilman present: Mayor Billy J. Burnett, <br />and Councilman Travis Wortham. Also present was City Manager, Michael <br />E. Malone, City Attorney Haynes, Director of Engineering, John Buss, <br />City Engineer, David Tompkins, and City Clerk, Mattie Cunningham. <br />Chairman Folmar announced that the special meeting was called to <br />consider the effect of proposed improvements to be make by the Church <br />of Christ of Latter Day Saints adjacent to Pine Mill Road. <br />After a considerable amount of discussion, Director of Engineering, <br />John Buss made the following recommendations as a procedure to follow: <br />1. Support off side drainage improvement where it is necessary <br />to prevent harm to down stream property owners. <br />2. Where it is necessary for easements to be obtained, to do that <br />a. The easements needs to be a natural drain. <br />b. The Developer has to have expired all efforts <br />on his own to acquire those through the private <br />market. <br />c. He has to hire an independent certified appraiser to <br />to appraise the cost and drainage of the easement, and <br />he must have offered the property owner that amount. <br />when these conditions are met, then they can approach the <br />City Council on an individual basis to see if the City <br />will use their condemnation powers to acquire the <br />easements. This is not guaranteed, and the Developer <br />should not go forward with purchase and construction <br />assuming that it will be condemned. <br />d. The Developer will pay all cost for the condemnation <br />cost and the off side drainage improvements. <br />e. The developer should also use an appraiser approved <br />by the City Attorney. <br />Mr. Buss stated that this seems to be a workable written policy. <br />After further discussion, the Committee was in agreement with the <br />procedures recommended by Mr. Buss. <br />Councilman Folmar requested that the possibility of selling the Lake <br />Crook property to a developer be placed on the agenda of the next <br />regular Council meeting for discussion. <br />Councilman Folmar also requested that the discussion of Hotel -Motel <br />Occupancy Tax be placed on the agenda of the next regular council <br />meeting. <br />
