Item No. 25 <br />memorandum <br />TO: Mayor & City Council <br />FROM: John Godwin, City Manager <br />SUBJECT: KENNY KAMMER TAX <br />DATE: February 2, 2015 <br />BACKGROUND: Mr. Kenny Kammer appeared at the January 26 council meeting to express <br />concerns about back taxes owed on property he purchased form the city in a public bid, and Dr. <br />Hashmi ask that an item be added to the February 9 agenda. Mr. Kammer had previously met <br />with the city attorney and the finance director <br />STATUS OF ISSUE: Mr. Kammer's property was not acquired as part of a delinquent tax sale, <br />as some may have thought. Instead, this was a lot that we owned outright after acquiring it in <br />2002. The lot was later declared surplus property; the city council authorized it to be sold at <br />public auction, as is, and Mr. Kammer was the high bidder. The property was subsequently <br />conveyed to him by a warranty deed. Back taxes from 2002 were owed to PJC, PISD, and <br />Lamar County prior to the city acquiring it. We did not owe those taxes, and are generally <br />prohibited from paying property taxes. None of the back taxes are owed to the city, so we have <br />no authority to forgive them; only the other three jurisdictions can do that. <br />BUDGET: NA. <br />RECOMMENDATION: Take no action. <br />
