W - 'i <br />• <br />MINUTES OF THE <br />CITY OF <br />MAY <br />BOARD OF ADJUSTMENT <br />PARIS, TEXAS <br />14, 1975 <br />The Board of Adjustment of the City of Paris met in a called meeting, <br />Wednesday, May 14, 1975, at 5:15 P.M. in the Council Room of City Hall <br />with the following members present: <br />1. F. D. Mallory III, Chairman <br />2. Ben Hinds <br />3. Dr. James Moore <br />4. Richard Nafe <br />5. Charlie Walker <br />The meeting was called to order by Chairman Mallory and the minutes of <br />April 7, 1975 were approved as written. <br />The first item on the agenda was the petition of Mr. 0. L. Rainey for a <br />variance to Ordinance No. 1710, Section 9 -301, Lot Depth Requirements in a <br />proposed subdivision of part of Lots 14 and 20, City Block 196 located <br />between Robin Road and Lamar Avenue at the east end of Houston Street. <br />Mr. Don McLaughlin, Attorney, spoke for Mr. Rainey stating that his request <br />for a deviation from the strict adherance to the Zoning Ordinance was <br />based on the following: <br />1. Due to the location of the property and its limitation in <br />width, a 50' wide street right of way and 100' minimum <br />depth lots cannot be provided for on 10 of the proposed 18 <br />lots in the subdivision. <br />2. Effort had been made to obtain additional land on the south <br />side of this property to comply with the Ordinance. Of the <br />four properties for which an offer was made to purchase, two <br />would not sell and the other two offered to sell at a price <br />Mr. Rainey could not pay. <br />3. Mr. Rainey is wilting to place restrictions on the property <br />to insure a development equal to the adjacent property. <br />Mr. McLaughlin read the proposed restrictions and stated that they could be <br />enforced by any property owner within the addition or contiguous to it. <br />He ended his statement by saying his client was entitled to some use of his <br />property and his proposal was reasonable. <br />Attorney Webb Board, speaking for some of the area residents adjacent to the <br />property, stated that regardless of the type of house proposed, his clients <br />were opposed to lots of this size. They believe that their substantial <br />investment in their homes would be devalued by substandard size lots. He <br />further stated his belief that additional land from those properties facing <br />Lamar Avenue could be purchased. <br />
