• <br />• <br />June 26, 1975 <br />i <br />MEMORANDUM: <br />TO: BOARD OF ADJUSTMENT <br />FROM: DIRECTOR OF COMMUNITY DEVELOPMENT <br />SUBJECT: AGENDA ITEMS FOR JULY 1, 1975 <br />In the construction of the Mc Donald's Restaurant on Lamar Avenue, a- walled <br />trash enclosure on the northwest corner of the property has been erected <br />which obstructs the view of traffic on 12th N.E. and E. Houston Street. <br />The enclosure was shown on the plans when the building permit was issued, <br />but was inadvertently overlooked by me and other staff members. The con- <br />struction of the enclosure was started and almost finished before we became <br />aware of the fact that it is in violation of the Yard Requirements of the <br />Zoning Ordinance. <br />We discussed the situation with Roger Napper of Mc Donald's and they wish <br />to leave it where it is. Attached is a copy of my letter to Mr. Napper <br />stating the City's position in the matter and a sketch showing the location <br />of the enclosure in relation to the two streets. <br />The appeal is to the two alternatives set forth in the letter which would <br />bring the enclosure into compliance with the Zoning Ordinance. <br />I regret that the matter has to come before the Board of Adjustment because <br />I feel greatly responsible for allowing it to occur. On the other hand, <br />Mc Donald's has the responsibility to design their plans according to <br />Building Code and Zoning Ordinance requirements. <br />It is the recommendation of myself and the Building Inspector that the <br />enclosure be made to conform to the Zoning Ordinance. <br />Thank you, <br />o N.
