•
•
June 26, 1975
i
MEMORANDUM:
TO: BOARD OF ADJUSTMENT
FROM: DIRECTOR OF COMMUNITY DEVELOPMENT
SUBJECT: AGENDA ITEMS FOR JULY 1, 1975
In the construction of the Mc Donald's Restaurant on Lamar Avenue, a- walled
trash enclosure on the northwest corner of the property has been erected
which obstructs the view of traffic on 12th N.E. and E. Houston Street.
The enclosure was shown on the plans when the building permit was issued,
but was inadvertently overlooked by me and other staff members. The con-
struction of the enclosure was started and almost finished before we became
aware of the fact that it is in violation of the Yard Requirements of the
Zoning Ordinance.
We discussed the situation with Roger Napper of Mc Donald's and they wish
to leave it where it is. Attached is a copy of my letter to Mr. Napper
stating the City's position in the matter and a sketch showing the location
of the enclosure in relation to the two streets.
The appeal is to the two alternatives set forth in the letter which would
bring the enclosure into compliance with the Zoning Ordinance.
I regret that the matter has to come before the Board of Adjustment because
I feel greatly responsible for allowing it to occur. On the other hand,
Mc Donald's has the responsibility to design their plans according to
Building Code and Zoning Ordinance requirements.
It is the recommendation of myself and the Building Inspector that the
enclosure be made to conform to the Zoning Ordinance.
Thank you,
o N. Mc Collum
