660 City Manager Malone told Mr. Swint that he feels that the desire of the Council is to address a specific problem and that problem is people are dumping in the Lake Crook Watershed which is one of our major sources of drinking water, we are getting all types of appliances, dead animals, and trash which creates a great expense to the City to remove from the watershed, and has been a continuing problem. City Manager Malone stated that the City does not have the means to police the area to prevent the problem, there have been a number of incidents that have occurred in the area, disturbances, people using the road with four wheel drive vehicles, four wheelers which do a great deal of damager to City property, and the Council is interested in protecting the City's interest. City Manager Malone stated that the Lake Crook Road, in the opinion of the City Attorney, is a road that is a park road owned and controlled by the City of Paris, and stated further that the road has been closed for many years; however, it has been physically opened. City Manager Malone said that the Council has received request that the road be physically closed to prevent these activities, and the City Attorney's opinion was that all necessary steps have been taken previously to close the road, and all that was lacking was a physical barrier to keep these people out, the property owners that adjoin the area traversed by the road, most of them have signed a petition asking that the road be closed, and believe that Mr. Swint is the property owner who did not sign the petition, who wants a key to the barrier, and a written maintenance agreement that the City maintain the condition of the road. City Manager Malone also advised that he has had a request from Mr. Gene Burns, who is a property owner, requesting a key to the gate and Mr. Burns offered to maintain that portion of the road that he would be using. Mr. Swint stated that there is no one in the County that is more in agreement that we need to control dumping, and feels that most of the dumping on the North Lake Crook Road is within 200 - 300 feet of the public road. Mr. Swint presented a drawing of the area, and asked if the City has any records of the City maintaining the road. City Attorney Haynes stated there were no record. Mr. Swint told the Council that he has records regarding the maintenance of the road by the County, but none where the City has ever maintained the road. That he has owned his property for 30 years, it is property that he will never use for his personal use, but would be property that he would probably sale at sometime, and contends that his property has been serviced by this road since Lake Crook was built. Mr. Swint stated that he has not used the road in years just because he could not get to his property by the use of this road except maybe in July, and sometimes not then. City Attorney Haynes read Resolution No. 1657 dated January 13, 1975 granting Richard B. Swint an easement of right of ways to property he owns adjacent to the North Boundary Line of City of Paris Lake Crook property with the following restrictions: 1. The City of Paris have no obligation to improve the easement granted or connecting roadways to said easement. 2. The City of Paris have no obligation to open, reopen or keep open any road across City property to provide ingress or egress to the easement herein granted. .� After further discussion, no action.was taken on Mr. Swint's request.
