During any periods when work is being performed on Premises in connection with Drainage Facilities, Carrier shall, at Licensee's cost, furnish such flagmen or protective services or devices and take such other action as, in Carrier's opinion, may be necessary for Carrier's protection in the conduct of railroad operations. 4. Carrier may, acting for Licensee, furnish or do and Licensee shall pay and bear the cost of anything which, herein required of Licensee at any time, either shall not be furnished or done within 10 days following Carrier's written request therefor or shall be undertaken by Carrier at Licensee's request; and Licensee on request shall in advance deposit with Carrier the estimated cost thereof. If deposit be less than actual cost, Licensee shall pay difference; if more, Carrier shall repay difference, and such cost shall be computed in accordance with the provisions of Section 5 hereof. 5. Licensee shall reimburse Carrier, within 30 days following receipt of bill therefor, for any and all cost incurred by reason of the work performed by Carrier pursuant to this agreement which cost shall include: (a) cost of all labor, including wages of foreman, plus 107 ..to cover accounting, supervision and use of tools; (b) vacation, holiday and health and welfare allowance of employes engaged in or connected with such work; (c) cost of materials and supplies f.o.b. Carrier's rails, plus 157. to cover handling, accounting and transportation expenses; (d) excise taxes applicable to said labor and materials; (e) premium on any insurance protection procured by Carrier in connection with said work; and (f) Carrier's current rental rates for any roadway machinery or equipment used in the performance of said work. 6. Licensed shall require any contractor, engaged or employed. to perform any work referred to herein on or about any part of Premises, to procure and keep in effect during the period of such work Workmen's Compensation Insurance - statutory limit, and contractor's public liability and property damage insurance, covering operations of such contractor or any of his subcontractors incident to or in connec- tion with the performance of said work. Such insurance shall provide for a limit of not less than $250,000 for all damages arising out of bodily injury to or death of one person, and, subject to that limit for each person, a total of $500,000 for all damages arising out of bodily injuries to or death of two or more persons in any single occurrence, and a limit of not less than $250,000 for all damages arising out of damage to or destruction of property in any single occurrence and, subject to that limit per occurrence, a total (or aggregate) limit of $500,000 for all damages arising out of damage to, or destruction of,property during the annual policy period. If any part of the work is sublet, similar insurance shall be provided by or on be- half of the subcontractors to cover their operations. 7.
