ORDINANCE NO. 2015 -003 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, <br />TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE LOT 1, BLOCK A, <br />OF THE HALL ADDITION CB 154, BEING LOCATED AT 1190 S.W. 6th <br />STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS, FROM A ONE - <br />FAMILY DWELLING DISTRICT NO. 2 (SF -2) TO A ONE - FAMILY <br />DWELLING DISTRICT NO. 3 (SF -3); GRANTING A SPECIFIC USE PERMIT <br />(39) FOR A MOBILE HOME ON THE PROPERTY; DIRECTING A CHANGE <br />ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING <br />A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A <br />PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission received a request for an <br />amendment to the Zoning Ordinance of the City of Paris to rezone Lot 1, Block A, of the Hall <br />Addition CB 154, City of Paris, Lamar County, Texas, from a One- Family Dwelling District <br />No. 2 (SF -2) to a One- Family Dwelling District No. 3 (SF -3) with a Specific Use Permit <br />(39) for a mobile home; and <br />WHEREAS, on February 2, 2015, following notice and publication as required by <br />law, the Planning and Zoning Commission conducted a public hearing on the proposed <br />amendment to the City Zoning Ordinance and, following said hearing, made formal <br />recommendation to the City Council to approve the requested zoning; and, <br />WHEREAS, on February 9, 2015, following notice and publication as required by <br />law, the City Council of the City of Paris conducted a public hearing on the proposed <br />amendment to the City Zoning Ordinance from the Planning & Zoning Commission, but the <br />amendment failed by a vote of 6 against and 1 in favor; and <br />WHEREAS, prior to the next regularly scheduled meeting of the City Council, <br />Councilman Benny Plata, who initially voted against the proposed zoning change, made a <br />motion to reconsider the proposed zoning change; said motion was approved by the <br />majority of the City Council at their Regular City Council meeting held on February 25, <br />2015; and <br />WHEREAS, City Council having considered the recommendation of the Planning and <br />Zoning Commission in support of rezoning the property from One- Family Dwelling District <br />No. 2 (SF -2) to One- Family Dwelling District No. 3 (SF -3) with a Specific Use Permit for a <br />mobile home and any evidence or testimony introduced at the public hearing, hereby finds <br />and determines that approving the referenced zoning change would be consistent with the <br />Comprehensive Future Land Use Plan of the City of Paris, consistent with the City Zoning <br />Ordinance, and in the best interests of the public health, safety, and welfare of the citizens <br />of the City of Paris by a vote of 7 ayes and 0 nays. <br />
