528 <br />suitable to the department head confirming a legitimate use of sick leave is required for <br />sick leave in excess of three (3) consecutive days or, any time deemed appropriate by the <br />supervisor. <br />D. Pay shall discontinue when authorized leave is exhausted. <br />E. If an employee becomes ill or injured during vacation, he /she may. request that the vacation <br />be terminated and the time of illness or injury be charged to sick leave. <br />F. False claims for sick leave are subject to disciplinary action. <br />G. Sick leave may not be traded for compensatory or vacation time. <br />H. Sick leave may not be transferred. The City does not maintain a sick leave pool. <br />I. Maternity leave will be treated like any other illness. <br />J. Sick leave may not be used while off the job due to a work related injury. <br />SECTION 14.06 — Family and Medical Leave <br />The Family and Medical Leave Act (FMLA) requires covered employers (the City is a covered <br />employer) to provide eligible employees with up to 12 weeks per year of leave, with protection of <br />the employee's job and continued medical benefits, for the following qualifying conditions: <br />A. To care for the employee's newborn son or daughter; <br />B. Because of the adoption or foster care placement of a child with the employee; <br />C. To care for the employee's spouse, son or daughter, or parent who has a serious health <br />condition; or <br />D. B .:, ausr of the employee's own serious health condition. <br />SECTION - 14.061- Eligibility <br />Generally, employees are eligible for family and medical leave if they have worked for the City for <br />at least 12 months and have worked at least 1,250 hours in the previous 12 months. The 12 -month <br />period will be a rolling 12 months which will be measured back from the date that an employee last <br />uses FMLA leave. <br />14.062 - Definitions <br />A. Serious health condition - an illness, injury, impairment, or physical or mental condition <br />that involves: 1) inpatient care in a hospital, hospice or residential medical facility; 2) <br />continuing treatment by a health care provider; or 3) any serious health condition that <br />34 Revised 01 -25 -05 <br />
