,45o <br />2. reporting for duty or remaining on duty having used or using any controlled _ <br />substance except when the use of such controlled substance is prescribed by a <br />physician who has advised the employee that the substance does not adversely affect <br />the employee's ability to safely and successfully perform the essential functions of the <br />job. <br />3. refusing to submit to a controlled substance or alcohol test required by this policy. <br />B. NO EXCEPTION - There shall be no exception to the prohibition of being on City property <br />or acting on City business while using or possessing a controlled substance or alcohol. <br />C. OFF -DUTY CONDUCT - The City of Paris reserves the right to take disciplinary action, <br />up to and including termination, in the event an employee's off -duty involvement with <br />controlled substances or alcohol is damaging to the City's reputation or business or is <br />inconsistent with the employee's job duties or when such off- -duty conduct results in <br />impairment of the employee's job performance. <br />1. Any employee convicted of or pleading guilty to a criminal drug/alcohol statute <br />violation shall notify his or her supervisor in writing no later than five (5) days <br />following such occurrence. For purposes of this Policy, a plea of nolo contendere <br />shall be considered a plea of guilty. <br />2. Any employee convicted of or pleading guilty to a criminal drug/alcohol statute <br />violation shall be subject to timely disciplinary action, up to and including <br />termination. <br />D. SEARCHES - The City of Paris reserves the right to conduct unannounced searches for <br />unauthorized substances anywhere on City property, including, but not limited to, lockers, <br />desks, file cabinets and employees' personal vehicles parked on City parking lots. Personal <br />property on City premises shall be subject to such searches. All such searches shall be <br />authorized and conducted under the direction of the City Manager or his designee. <br />Employees who refuse to cooperate during such unannounced searches shall be subject to <br />disciplinary action, up to and including termination. Body searches of employees shall not <br />be conducted by City personnel other than by law enforcement officers in the performance <br />of their official duties. <br />SECTION 17.07 - General Procedures <br />A. HIRING - Offers of employment with. the City will be tentatively based on successfully <br />completing and passing the controlled substance and alcohol screens. Any offer ' of <br />employment will be nullified if the employee is found to be engaging in the use or <br />consumption of controlled substances or the abuse of alcohol, unless such controlled <br />substance is. prescribed for the user by a physician, and then only if such controlled <br />53 <br />Revised 01 -25-05 <br />
