Item No. 14 <br />memorandum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Shawn Napier, P.E., Director of Engineering, Planning, and Development <br />SUBJECT: ZONING CHANGE FROM A GENERAL RETAIL DISTRICT (GR) AND A <br />ONE - FAMILY DWELLING DISTRICT (SF -2) TO A COMMERCIAL DISTRICT (C) <br />WITH A SPECIFIC USE PERMIT OF (55 SELF STORAGE/MINI WAREHOUSE) <br />LOCATED IN THE 2500 BLOCK OF LAMAR AVENUE <br />DATE: August 4, 2015 <br />BACKGROUND: This application is for a public hearing to consider the petition of Skyler <br />Burchinal for a change in zoning from a General Retail District (GR) and One - Family Dwelling <br />District No. 2 (SF -2) to Commercial District (C) with a Specific Use Permit (55 -Self <br />Storage /Mini Warehouse) on Lot 7, part of 8 and 9, City Block 249, being located in the 2500 <br />Block of Lamar Avenue. The applicant is not the owner of this subject property. The Planning <br />& Zoning Commission denied the zoning change request on August 3, 2015 by a vote of 7 -0. <br />The applicant requested a public hearing before the Paris Board of Adjustment to consider <br />allowance of a minimum side yard variance from the required ten (10) feet to three (3) feet, for a <br />seven (7) foot variance; the applicant also requested a rear yard variance of seven (7) feet from <br />the required ten (10) feet, for a variance of seven (7) feet. Mr. Burchinal was not present at this <br />hearing, which was held on July 28; the board denied both of his variance requests. <br />After Mr. Burchinal submitted his zoning change request and plats for the subject property it was <br />discovered that ATMOS had an easement on the property that would limit what Mr. Burchinal <br />could build. <br />STATUS OF ISSUE: Mr. Burchinal has not purchased the property. The application that has <br />been submitted to the City of Paris list Mr. Burchinal as the property owner. This application <br />cannot be legally approved. <br />RECOMMENDATION: Recommend denial of the zoning change. <br />
