965 Attachment D Standard Provisions and Assurances 34.0. SAFETY AND PROTECTION 34.1. Where applicable, CONTRACTOR shall be responsible for requiring subcontractors and subgrantees to maintain and supervise all necessary safety precautions and programs in connection with the work. CONTRACTOR shall take all necessary safety precautions. 35.0. ACCOUNTING SYSTEMS 35.1. The CONTRACTOR shall have an accounting system which accounts for costs in accordance with generally accepted accounting standards or principles and complies with applicable State law, regulations, and policies relating to accounting standards or principles. The CONTRACTOR must account for costs in a manner consistent with such standards or principles. 36.0. INDEPENDENT FINANCIAL AUDIT 36.1. The CONTRACTOR shall engage an independent financial auditor and conduct an annual audit of the CONTRACTOR'S financial statements in accordance with the Single Audit provisions of UGMS and those items set forth in this Section. 36.1.1. All terms used in connection with audits in this Agreement shall have the definitions and meanings assigned in the Single Audit Circular in UGMS. 36.1.2. Provisions of the Single Audit Circular in Part IV of UGMS shall apply to all non -state entities expending the funds of this grant, whether they are recipients, receiving the funds directly from the TNRCC, or are subrecipients, receiving the funds from a pass - through entity (a recipient or another subrecipient). In addition, the CONTRACTOR shall require the independent auditor to supply all audit work papers substantiating the work performed, at the request of the TNRCC or its designee. 37.0. HAZARDOUS SUBSTANCES, WASTE DISPOSAL AND MANIFESTS 37.1. CONTRACTOR, subcontractors and subgrantees must comply with all applicable Laws and Regulations, including but not limited, to those relating to hazardous substances, waste disposal and manifests. 54
