717 <br />development of the project. <br />B. The City will be responsible for the remediation of any hazardous materials <br />identified within the limits of the Project site. All costs associated with the <br />investigation and remediation of environmental problems will be limited to the <br />budgeted amount in Paragraph XI, Division 1, of Exhibit A, attached hereto, which <br />was heretofore approved by the Commission upon approval of the original <br />application for Interstate Transportation Enhancement Act Funding, and the City <br />will be reimbursed or credited toward its financial share of the Project. However, <br />if the cost of remediation is excessive or beyond the budgeted amount, the contract <br />may be terminated in accordance with TERMINATION, Section 16. <br />C. Should any portion of the project site require remediation during the project <br />implementation, identified area(s) will be avoided and will not be developed until <br />all environmental concerns have been adequately addressed in accordance with <br />applicable federal, state, and local laws and regulations. <br />D. The City will be responsible for the mitigation of project impacts (such as . <br />wetlands, threatened and endangered species, cultural resources, etc.) that result <br />from apy agreements, permits, and /or coordination that is necessary to complete <br />the environmental, public involvement, and construction phases of the Project. All <br />costs associated with these with these types of mitigation will be funded under the <br />eligible cost limits of the Project. <br />7 <br />
