COs <br />RESOLUTION NO. 9 5 - 017 <br />WHEREAS, the City Council of the City of Paris (lid heretofore on the 9th day <br />of January, 1995, pass Resolution No. 95 -001, which said Resolution was incorrect and <br />requires correction; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />that Resolution No. 95 -001, be, and the same is hereby amended to read as follows: <br />"WHEREAS, the Texas Parks & Wildlife Department provides funding for <br />Texas Recreation & Parks Account (TRPA) Program grants (Section 24 of the Parks & <br />Wildlife Code) for project not to exceed $1,000,000.00; and, <br />WHEREAS, the City Council of the City of Paris is desirous of processing a grant <br />application for a municipal swimming pool, at an estimated cost of $571,500.00 with the <br />cost being paid 50% Texas Parks & Wildlife Department and 50% local match which <br />may include in kind services, land and funds; and, <br />WHEREAS, the City of Paris is fully eligible to receive assistance under the <br />TRPA Program; <br />WHEREAS, the Texas Parks and Wildlife Department requires that the property <br />on which the project will be located will be protected by the City of Paris from any future <br />drilling or open mining, and it is appropriate that the City of Paris commit to protecting <br />such property; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />1. That an application be made to the Texas Parks & Wildlife Department <br />for a Texas Recreation & Parks Account (TRPA) Program Grant in the amount of <br />$285,750.00, being approximately 50 % of the estimated cost of the municipal swimming <br />pool project, said total project cost being $571,500.00, with the City of Paris providing <br />$285,750.00 in kind services, land and funds, which matching share for this application <br />is readily available at this time. <br />2. That Michael E. Malone, City Manager of the City of Paris, be, and lie is <br />hereby appointed as the Authorized Official of said project and is authorized and directed <br />to execute on behalf of the City of Paris the application for grant in the form attached <br />hereto as Exhibit A. <br />3. That Dick Boots, be, and he is hereby appointed as Project Director and is <br />hereby authorized to execute and deliver on behalf of the City of Paris all reports, <br />communications, assurances and documents necessary for the completion of said project. <br />4. That W. E. Anderson, Director of Finance, be, and he is hereby authorized <br />and directed to serve as the Financial Officer for said project and to receive and distribute <br />funds for purposes of the construction of a municipal swimming pool. <br />5. That the site to be known as the City of Paris Municipal Swimming Pool <br />and Recreational Area in the City of Paris, Paris, Texas for use as a park site, being <br />Lot 6, City Block 276 is hereby dedicated for a public park and recreation purposes in <br />perpetuity, which dedication becomes null and void in the event that the above described <br />grant application is rejected; and, <br />
