RESOLUTION NO. 89 -024
<br />WHEREAS, the City Manager of the City of Paris has
<br />heretofore received a request from Ralph Taylor, Pastor of the
<br />Bethel Temple Church, for a pro rata water main extension to
<br />serve property.located in Lot 17, City Block 188E which fronts on
<br />the north side of S.E. Loop 286; and,
<br />WHEREAS, it is deemed appropriate to permit Bethel Temple
<br />Church to act as sponsor under the terms of Section IX of the
<br />Subdivision Ordinance No. 1315 of the City of Paris with any
<br />refunds due under said ordinance being paid to Bethel Temple
<br />Church or their successors or assigns; and,
<br />WHEREAS, upon receipt of the above described request,
<br />preliminary plans, specifications and estimate of the total
<br />cost of the project were prepared by Chaney Engineering and
<br />approved by Earl Smith, City Engineer and delivered to the City
<br />Manager and considered at the regular Council Meeting on the 13th
<br />day of February, 1989, and a public hearing concerning the same
<br />was set for March 13, 1989, at which time such public hearing was
<br />held; and,
<br />WHEREAS, after hearing the matters presented at the
<br />public hearing, the City Council is of the opinion that
<br />Bethel Temple Church is entitled to have a pro rata water main
<br />extension and to act as sponsor for said project; and,
<br />WHEREAS, such project should be known as the Pro Rata Water
<br />Line Extension Bethel Temple, S.E. Loop 286 Project which has a
<br />total estimated cost of $59,330.80; the front foot method would
<br />be equitable and is the method described on Exhibit A attached
<br />hereto; NOW, THEREFORE,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
<br />PARIS, That the pro rata water main extension beginning
<br />approximately 790 feet west. of the west boundary line of 6th
<br />Street S.E. intersection with the north boundary line of SE Loop
<br />286 and runs easterly along the north right of way line of Loop
<br />286 S.E. approximately 3,268 feet, be, and the same is hereby
<br />approved and shall be known as "Pro Rata Water Line Extension
<br />Bethel Temple, S.E. Loop 286 "; and,
<br />BE IT FURTHER RESOLVED, That Bethel Temple Church act as
<br />sponsor of said pro rata water main extension and pay the total
<br />construction cost, less the oversizing cost which will be paid by
<br />the City of Paris; and,
<br />BE IT FURTHER RESOLVED,

<br />BE IT FURTHER RESOLVED, That the City Manager, Michael
<br />E. Malone, be, and he is hereby authorized and directed to
<br />proceed with said project and to execute a pro rata contract
<br />with Bethel Temple Church upon completion of the project
<br />providing for refund of pro rata charges collected under sub
<br />paragraph (1) of paragraph B of Section IX of Ordinance 1315
<br />of the City of Paris; however, in no case shall the total
<br />construction cost, less the oversizing cost of $16,762.97 exceed
<br />the estimated project cost of $59,330.80, which total cost is to
<br />be pro rated as described in Exhibit A attached hereto, and upon
<br />collection, in accordance with the above described ordinance, be
<br />paid to Bethel Temple Church, sponsor.
