92 <br />RESOLUTION NO, 1642 <br />WHEREAS, the City Council of the City of Paris did heretofore <br />advertise for bids in accordance with the laws of the State of Texas <br />and the Charter of the City of Paris for furnishing all necessary <br />labor, materials, superintendence and equipment required for the <br />relocation and adjusting of water and sewer mains at N. W. Loop 286, <br />between F. M. Highway 79 and U. S. Highway 82 West, in accordance <br />with detailed plans and specifications provided for said project, which <br />bids were received until 10:00 o'clock A. M. , Wednesday, October 16, <br />1974; and, <br />WHEREAS, M. L. Smyers' bid of $40,393. 64 was the best bid; <br />and, <br />WHEREAS, the State of Texas requires a Joint Use Agreement <br />establishing the rights between the State of Texas and the City of Paris <br />with regard to utilities placed within the right of way of the improve- <br />ment project of N. W. Loop 286, between F. M. Highway 79 and U. S. <br />Highway 82 West; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, That the bid of M. L. Smyers for furnishing all necessary <br />labor, materials, superintendence and equipment required for the re- <br />location and adjusting of water and sewer mains at N. W. Loop 286, <br />between F. M. Highway 79 and U. S. Highway 82 West, in the amount <br />of $40,393. 64, is hereby accepted and let; and, <br />BE IT FURTHER RESOLVED, That the Mayor of the City of <br />Paris, James M. Brunette, be, and he is hereby authorized and directed <br />to execute on behalf of the City of Paris a contract with M. L. Smyers, <br />for furnishing all necessary labor, materials, superintendence and <br />equipment required for the relocation and adjusting of water and sewer <br />mains at N. W. Loop 286, between F. M. Highway 79 and U. S. Highway <br />82 West; in the amount of $40,393. 64, a copy of which is attached <br />hereto as Exhibit. A; and, <br />BE IT FURTHER RESOLVED, That the City Manager, Kerry R. <br />Sweatt, be, and he is hereby authorized and directed to execute a <br />Joint Use Agreement between the State of Texas and the City of Paris <br />in the form attached hereto as Exhibit B. <br />Passed and adopted this 21st day of October, 1974. <br />ATTEST: <br />C.
