WHEREAS, the State and. City have previous to this date entered into a contract agreeing .to handle try separate contract the adjustment, removal or relocation of certain ut.il.iLa facilities necessitated as-a result of highway improvements on the subject project or. the basis or a predetermined firm commitment for right of way reimbursement approved by the State; MEF^'E rtS, the agner, in an affidavit dated Jaguar 20 , 19 75 has inserted an inre_est in certain lands and that this proposed highway improvement wi13 - necessitate the ad3ustr..ent, removal or relocation of certain facilities of the O'�r:�r new located upon such lands as indicated in the following statement of work: Relocate some 354 feet of 8. -inch h_i,gh pressure gas transmission maix-i line at the intersection of U. S. 82 and F. M. 79. a the State and the City desire to accomplish the adjustment, removal or.ralocation of the Owner's utility facilities by entering into an agreement with the t?..*ner; NC(.,1, THEREFORE, be it mutually agreed that this contract entered into this date between the parties hereto is intended to implement and effectuate the terms and provisions of that contract of January 13 �, 1971 , entered into bet=..leen the State and the City, as it pertains to -right of way utility adjustments and as it effects the utility facilities. of the Owner.
