1152 Regular Council Meeting <br />July 26, 2010 <br />Page 4 <br />CONSTRUCTION COMPANY, L.P., THE LOWEST RESPONSIBLE BIDDER; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; <br />AND DECLARING AN EFFECTIVE DATE. <br />A Motion to award the contract to Richard Drake Construction Company for $111,553.00 <br />was made by Council Member McCarthy and seconded by Council Member Brown. Motion <br />carried, 7 ayes — 0 nays. <br />15. Deliberate and possibly act on RESOLUTION NO. 2010 -084: A RESOLUTION OF <br />THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ACCEPTING THE <br />CONVEYANCE OF A RAINBOW TRUSS BRIDGE, KNOWN AS THE GOODMAN <br />BRIDGE FROM NACOGDOCHES COUNTY, TEXAS FOR PLACEMENT AND USE <br />AS PART OF TRAIL DE PARIS; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. <br />A Motion to approve this item was made by Council Member Pickle and seconded by <br />Council Member Rhonda Rogers. Motion carried, 7 ayes — 0 nays. <br />16. Deliberate and possibly act on temporarily suspending the landfill RFP process and to <br />evaluate all options concerning landfill disposal and residential sanitation collection. <br />Council Member Jason Rogers said that he would like to suspend the RFP process and <br />look at all options. He said with the contract with Waste Management expiring and a new <br />landfill being built, that there would be more available options. Council Member Pickle said that <br />he would like to continue with the RFP process, while Mayor Biard said he wanted to look at a <br />RFP for the landfill and residential sanitation. Council Member Pickle said he would like the <br />RFP to have two options, one for the landfill only and one to include the landfill fees and <br />residential sanitation fees. Council Member Jason Rogers emphasized that he wanted to receive <br />input from sanitation employees. Council Member Rhonda Rogers suggested that once Council <br />receives numbers, that they hold a workshop. It was a consensus of the City Council to have <br />staff bring back for review a proposed RFP with two options, one being for the landfill fees only <br />and the other one to include both landfill and residential sanitation fees combined. Council <br />asked that the RFP include city equipment and personnel. <br />17. Convene into Executive Session pursuant to Section 551.071 of the Texas Government <br />Code, Consultation with Attorney, to receive legal advice from the City Attorney about <br />pending or contemplated litigation and/or on matters in which the duty of an attorney to <br />his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of <br />Texas, clearly conflict with this chapter. <br />Mayor Biard convened City Council into executive session at 6:13 p.m. <br />18. Reconvene in Open Session. <br />Mayor Biard reconvened City Council into open session at 6:41 p.m. <br />
