Motion carried, 7 ayes — 0 nays. 1483 <br />A Motion to approve the support for funding a portion of the right -of -way acquisition <br />costs and utility relocation costs for upgrading and widening State Highway 24 from the City of <br />Cooper, Texas to the Delta -Hunt County line in amount of $1,450,000.00 was made by Council <br />Member Pickle and seconded by Council Member Frierson. Motion carried, 7 ayes — 0 nays. <br />34. Deliberate and possibly act on RESOLUTION NO. 2012 -023: A RESOLUTION OF <br />THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AN <br />INTERLOCAL COOPERATION AGREEMENT BETWEEN SULPHUR RIVER <br />REGIONAL MOBILITY AUTHORITY (SURRMA) DELTA COUNTY, TEXAS, <br />LAMAR COUNTY, TEXAS, CITY OF PARIS, TEXAS, CITY OF COOPER, TEXAS, <br />AND THE PARIS ECONOMIC DEVELOPMENT CORPORATION PERTAINING TO <br />FUNDING PART OF THE COST OF UPGRADING AND WIDENING A 10.4 MILE <br />SEGMENT OF STATE HIGHWAY 24 AND APPROVING A STATE <br />INFRASTRUCTURE BANK LOAN BETWEEN THE TEXAS DEPARTMENT OF <br />TRANSPORTATION AND SURRMA; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mr. Horton told the City Council this item involved determining how the City was going <br />to pay their portion of the loan. Mayor Hashmi asked if there was a pre -pay penalty and Mr. <br />Horton said there was not. <br />A Motion to pay the entire sum at one time was made by Council Member Wright and <br />seconded by Council Member Avila. Motion carried, 4 ayes — 3 nays, with Council Members <br />Grossnickle, Frierson and Pickle casting the dissenting votes. <br />Council Member Pickle said if the City pays it all off at one time, and the City had an <br />emergency type situation that the City would not be able to fund anything. <br />Mayor Hashmi asked if Council wanted to reconsider this item. <br />A Motion to reconsider this item was made by Council Member Pickle and seconded by <br />Council Member Frierson. Motion carried, 7 ayes — 0 nays. <br />City Attorney Kent McIlyar said he was at the PEDC meeting earlier in the day and <br />Lamar County did not vote to pay all their funds in one lump sum. Mr. McIlyar said the concern <br />was that it could take years to purchase right -of -ways and that the exact final number was <br />unknown. He said he did not believe it was prudent for the City to be the only one to pay their <br />money up -front and be in a situation where the project failed or the loan did not come through, <br />leaving the City in a position to have to claw that 1.45 million dollars back. Mr. Horton said the <br />numbers were estimates and could come in over or under. Mr. McIlyar said once the numbers <br />
