Motion carried, 7 ayes — 0 nays. 1483 A Motion to approve the support for funding a portion of the right -of -way acquisition costs and utility relocation costs for upgrading and widening State Highway 24 from the City of Cooper, Texas to the Delta -Hunt County line in amount of $1,450,000.00 was made by Council Member Pickle and seconded by Council Member Frierson. Motion carried, 7 ayes — 0 nays. 34. Deliberate and possibly act on RESOLUTION NO. 2012 -023: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AN INTERLOCAL COOPERATION AGREEMENT BETWEEN SULPHUR RIVER REGIONAL MOBILITY AUTHORITY (SURRMA) DELTA COUNTY, TEXAS, LAMAR COUNTY, TEXAS, CITY OF PARIS, TEXAS, CITY OF COOPER, TEXAS, AND THE PARIS ECONOMIC DEVELOPMENT CORPORATION PERTAINING TO FUNDING PART OF THE COST OF UPGRADING AND WIDENING A 10.4 MILE SEGMENT OF STATE HIGHWAY 24 AND APPROVING A STATE INFRASTRUCTURE BANK LOAN BETWEEN THE TEXAS DEPARTMENT OF TRANSPORTATION AND SURRMA; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Mr. Horton told the City Council this item involved determining how the City was going to pay their portion of the loan. Mayor Hashmi asked if there was a pre -pay penalty and Mr. Horton said there was not. A Motion to pay the entire sum at one time was made by Council Member Wright and seconded by Council Member Avila. Motion carried, 4 ayes — 3 nays, with Council Members Grossnickle, Frierson and Pickle casting the dissenting votes. Council Member Pickle said if the City pays it all off at one time, and the City had an emergency type situation that the City would not be able to fund anything. Mayor Hashmi asked if Council wanted to reconsider this item. A Motion to reconsider this item was made by Council Member Pickle and seconded by Council Member Frierson. Motion carried, 7 ayes — 0 nays. City Attorney Kent McIlyar said he was at the PEDC meeting earlier in the day and Lamar County did not vote to pay all their funds in one lump sum. Mr. McIlyar said the concern was that it could take years to purchase right -of -ways and that the exact final number was unknown. He said he did not believe it was prudent for the City to be the only one to pay their money up -front and be in a situation where the project failed or the loan did not come through, leaving the City in a position to have to claw that 1.45 million dollars back.
