Regular Council Meeting February 27, 2012 STUDY THE REQUEST AND TO ESTABLISH REASONABLE RATES; APPROVING COOPERATION WITH ATMOS CITIES STEERING COMMITTEE' ( "ASCS ") AND OTHER CITIES IN THE ATMOS MID-TEX SERVICE AREA TO HIRE LEGAL AND CONSULTING SERVICES AND TO NEGOTIATE WITH THE COMPANY AND DIRECT ANY NECESSARY LITIGATION AND APPEALS; REQUIRING REIMBURSEMENT OF CITIES' RATE CASE EXPENSES; FINDING THAT THE MEETING AT WHICH THIS RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; REQUIRING NOTICE OF THIS RESOLUTION TO THE COMPANY AND ACSC'S LEGAL COUNSEL; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Council Member Wright left the meeting at 7:45 p.m. Gene Anderson said the purpose of this resolution was to extend the effective date of Atmos Mid -Tex's proposed rate increase to give the City time to review the rate -filing package. Mr. Anderson said this resolution suspends the March 6, 2012 effective date of the Company's rate increase. A Motion to suspend the March 6, 2012, effective date of Atmos Energy Corp requested rate change to permit the City time to study the request and to establish reasonable rates; approving cooperation with Atmos Cities Steering Committee to hire legal and consulting services and to negotiate with the Company was made by Council Member Frierson and seconded by Council Member Pickle. Motion carried, 5 ayes — 0 nays. Council Member Wright returned to the meeting at 7:47 p.m. 27. Deliberate and act on RESOLUTION NO. 2012 -021: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AWARDING THE BID FOR THE SALE OF SCRAP METERS, BRASS, COPPER AND MISCELLANEOUS SCRAP METAL TO PARIS IRON AND METAL THE HIGHEST RESPONSIBLE BIDDER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to accept the bid from Paris Iron & Metal for purchase from the City, scrap meters, brass, copper and miscellaneous scrap metal was mad by Council Member Pickle and seconded by Council Member Frierson. Motion carried, 6 ayes — 0 nays. 35. Convene into Executive Session: • Pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his contemplated litigation and/or on matters in which the duty of an attorney to his client
