First reading, deliberate and possibly act on ORDINANCE NO. 2012 -016: AN <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING SECTION 7 -50 OF ARTICLE III OF CHAPTER 7 OF THE CODE OF <br />ORDINANCES OF THE CITY OF PARIS, TEXAS TO ALLOW THE HISTORIC <br />PRESERVATION COMMISSION TO REVIEW ALL BUILDINGS AND <br />STRUCTURES IN THE HISTORICAL DISTRICT, FOR ALL DESIGNATED <br />LANDMARK BUILDINGS AND STRUCTURES WITH A FEDERAL, STATE OR <br />LOCAL LANDMARK DESIGNATION, AND FOR ALL BUILDINGS AND <br />STRUCTURES FIFTY (50) YEARS OR OLDER THAT ARE CONSIDERED <br />DANGEROUS BY THE CITY'S CODE INSPECTORS TO DETERMINE WHETHER <br />SUCH BUILDING OR STRUCTURE CAN BE REHABILITATED OR <br />DESIGNATED; AND AMENDING SECTIONS 7- 50(f)(g)(h) OF ARTICLE III, <br />CHAPTER 7 OF THE CODE OF ORDINANCES TO INCREASE THE NUMBER OF <br />DAYS GIVEN TO THE HISTORIC PRESERVATION COMMISSION TO DEVELOP <br />A PLAN FOR SAVING, PRESERVING OR REHABILITATING THE <br />SUBSTANDARD STRUCTURE FROM NO LESS THAN NINETY (90) CALENDAR <br />DAYS TO NO LESS THAN ONE HUNDRED EIGHT (180) CALENDAR DAYS; <br />REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT <br />HEREWITH; AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Napier said this change was requested by the City Council Task Force on <br />Substandard Buildings, which would allow Historic Preservation Commission to act on all <br />buildings and structures in the historical district. Mr. Napier said the change also included the <br />number of days of deferment on any order of demolition for the building or structure from at <br />least ninety calendar days to one - hundred eight (180) calendar days. <br />With regard to funds for structural engineers, Council Member Wright said that Mr. <br />Anderson recommended that funds be taken out of the general fund for the immediate time and <br />address structural engineer funds in the upcoming budget process. <br />A Motion to invoke the super majority rule was made by Council member Frierson and <br />seconded by Council Member Lancaster. Motion carried, 6 ayes — 0 nays. <br />A Motion to approve the amendments was made by Council Member Wright and <br />seconded by Council Member Frierson. Motion carried, 6 ayes — 0 nays. <br />Convene into Executive Session pursuant to Section 551.071 of the Texas Government <br />Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending <br />or contemplated litigation and/or on matters in which the duty of an attorney to his client under <br />the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts <br />with this chapter. <br />
