Item No. 13 <br />memorandum <br />TO: City Council <br />John Godwin, City Manager <br />FROM: Kent McIlyar, City Attorney <br />SUBJECT: Disannexation Requests FM 1508 /Airport Rd. <br />DATE: August 18, 2015 <br />BACKGROUND: At the June City Council meeting, Boyd & Deborah Hudgens, Charles Keys <br />and several other residents with property inside the city limits near FM 1508 /Airport Road came <br />before the City Council and requested the Council to consider disannexing their properties from <br />the City of Paris because they do not receive city water or sewer service in that area. The City <br />Manager informed the City Council that while these property owners receive city services such <br />as police, fire and EMS, the City does not have immediate plans to run water or sewer lines <br />down Airport Road, because there is already a Lamar County Water Supply District (LCWSD) <br />water line serving the area and there is not enough population or development in the area to <br />justify running long sewer lines and lift stations in the area. <br />STATUS OF ISSUE: This is the first public hearing for the proposed 566.58 acre FM 1508/ <br />Airport Road Disannexation. <br />The City Engineering Department with assistance from Keith Whitley, RPLS have prepared <br />legal descriptions of the four tracts to be disannexed from the City of Paris on September 28, <br />2015: <br />Tract 1: 1.378 acres of land "Fuller Tract" <br />Tract 2: 21.3 acres of land "DeVoss Tract" <br />Tract 3: 399.9 acres of land north of FM 1508 /Airport Road <br />Tract 4: 144 acres of land south of FM 1508 /Airport Road <br />PROCESS: The process for disannexing properties from the City of Paris requires two public <br />hearings over a 40 -day period and publication of notice of the public hearing 10 -20 days prior, as <br />well as notice to Lamar County, School Districts and Railroad Companies. Once the City <br />Council directs staff which parcels are to be disannexed it will take approximately 90 days to <br />completion. The first public hearing is August 24, 2015 and the second August 31, 2015. <br />BUDGET: Tax base reduction. <br />RECOMMENDATION: N/A <br />
