ORDINANCE NO. 2015 -029 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A SITE PLAN FOR RETAIL SHOPPING CENTER IN A PLANNED DEVELOPMENT DISTRICT ON LOTS 8 & 9, CITY BLOCK 296, BEING LOCATED AT 3215 & 3225 LAMAR AVENUE, PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, previously the City Council of the City of Paris, approved an Ordinance establishing a Planned Development District (PD -a: retail shopping center) for property described as Lots 8 & 9, City Block 296, being located at 3215 & 3225 Lamar Avenue, Paris, Texas. WHEREAS, Klement Investment has filed a Site Plan with the City Engineer to construct a Retail Shopping Center on the Property; and, WHEREAS, the Site Plan was submitted and heard at a Public Hearing before the City's Planning and Zoning Commission and on October 5, 2015 was approved by the Commissioners; and, WHEREAS, on October 12, 2015, Klement Investment's site plan was submitted and heard at a Public Hearing before the City Council for consideration and the City Council approved said Site Plan; and, WHEREAS, pursuant to the City of Paris' Zoning Ordinance regulations, the Site Plan was presented to the City Council for their review and consideration and was approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Site Plan, for Lots 8 & 9, City Block 296, being located at 3215 & 3225 Lamar Avenue, is hereby, approved. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance.
