GMS APPLICATION NUMBER 2015- H4184 -TX -DJ <br />THE STATE OF TEXAS <br />KNOW ALL BY THESE PRESENT <br />COUNTY OF LAMAR <br />FIRST AMENDED INTERLOCAL AGREEMENT <br />BETWEEN THE CITY OF PARIS, TEXAS, AND COUNTY OF LAMAR, TEXAS <br />2015 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This Agreement is made and entered into this _ day of , 2015, by and between the <br />COUNTY OF LAMAR, TEXAS acting by and through its governing body, the Commissioners Court, <br />hereinafter referred to as COUNTY, and the CITY OF PARIS, TEXAS acting by and through its <br />governing body, the City Council, hereinafter referred to as CITY, both of Lamar County, State of <br />Texas, witnesseth: <br />WHEREAS, on or about July 13th, 2015, the CITY entered into an Interlocal Agreement with <br />the COUNTY to make a joint application for a 2015 Edward Byrne Memorial Justice Assistance <br />Grant in the amount of $12,237.00; and <br />WHEREAS, the U.S. Justice Department has requested the parties to amend their Interlocal <br />Agreement to state that the CITY will be using its portion of the 2015 JAG award funds to purchase <br />a federally controlled device, to wit: a drone; for law enforcement purposes. <br />WHEREAS, this Agreement is made under the authority of Chapter 791, Texas Government <br />Code; and, <br />WHEREAS, each governing body, in performing governmental functions or in paying for the <br />performance of governmental functions hereunder, shall make that performance or those <br />payments from current revenues legally available to that party; and, <br />WHEREAS, each governing body finds that the performance of this Agreement is in the best <br />interests of both parties, that the undertaking will benefit the public, and that the division of costs <br />fairly compensates the performing party for the services or functions under this agreement; and, <br />WHEREAS, the CITY will make application for a 2015 Byrne Justice Assistance Grant on <br />behalf of the City of Paris and Lamar County; and, <br />WHEREAS, the CITY agrees to act as fiscal agent and to provide the COUNTY $6,118.50 from <br />the JAG award for the 2015 Justice Assistance Grant Program; and, <br />Page 1 of 3 <br />
