ARTICLE 11 - EQUAL EMPLOYMENT OPPORTUNITY
<br />In connection with the execution of this Agreement, CONSULTANT shall not
<br />discriminate against any employee or applicant for employment because of race,
<br />religion, color, sex or national origin. CONSULTANT shall take affirmative action to
<br />ensure that applicants are employed and that employees are treated during their
<br />employment without regard to their race, religion, color, sex or national origin. Such
<br />actions shall include but not be limited to the following: employment, upgrading,
<br />demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates
<br />of pay, or other forms of compensation; and selection for training, including
<br />apprenticeship.
<br />ARTICLE 12 - NONDISCRIMINATION (FEDERAL REQUIREMENT)
<br />During the performance of this Agreement, CONSULTANT will not discriminate
<br />against any employee, or applicant for employment, because of race, creed, color, sex,
<br />marital status, religion, age, disability or national origin or ancestry, age, physical or
<br />mental handicap unrelated to ability, or an unfavorable discharge from military service..
<br />CONSULTANT will take affirmative action to ensure that applicants are employed, and
<br />that employees are treated during employment without regard to their race, religion,
<br />color, sex or national origin. Such actions shall include, but not be limited to the
<br />following:
<br />1) CONSULTANT will, in all solicitations or advertisements for employees
<br />placed by or on behalf of CONSULTANT, state that all qualified applicants
<br />will receive consideration for employment without regard to race, creed, color,
<br />sex, marital status, religion, age, disability or national original or ancestry,
<br />age, physical or mental handicap unrelated to ability, or an unfavorable
<br />discharge from military service.
<br />2) CONSULTANT will comply with all provisions of Executive Order 11246 of
<br />September 24, 1965 and of the rules, regulations, and relevant orders of the
<br />Secretary of Labor.
<br />3) CONSULTANT will furnish all information and reports required by Executive
<br />Order 11246 of September 24, 1965, and by rules, regulations, and orders of
<br />the Secretary of Labor or pursuant thereto, and will permit access to its
<br />books, records, and accounts by the administering agency and the Secretary
<br />of Labor for the purposes of investigation to ascertain compliance with such
<br />rules, regulations, and orders.
<br />ARTICLE 13 - RETENTION OF RECORDS
<br />The CONSULTANT will maintain all books, documents, papers, accounting
<br />records and other evidence pertaining to cost incurred and to make such materials
<br />available at their respective offices at all reasonable times during the Agreement period
<br />and for three years from the date of the final payment under this Agreement, for
<br />inspection by the CLIENT or any other authorized representatives, and copies thereof
<br />shall be furnished if requested.
