00 - AGENDACITY COUNCIL AGENDA Notice is hereby given that the City Council of the City of Paris shall meet in regular session at 5:30 p.m. on Monday, June 13, 2016. The meeting will be held at the City Council Chamber, 107 E. Kaufinan Street, in Paris, Texas. The matters to be discussed and acted upon are as follows: Opening Agenda 1. Call meeting to order. 2. Invocation. 3. Pledge of Allegiance. 4. Citizens' forum. (Persons desiring to address the Council must limit their presentation to no more than two minutes. Unless an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Council from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personnel appeals are not appropriate for citizens' forum.) If necessary, the City Council may convene into Executive Session under Chapter 551 of the Texas Government Code regarding any item on this agenda. Consent Agenda Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable to all items appearing on the Consent Agenda. A Council Member may request any item to be removed from the Consent Agenda and considered as a separate item. 5. Approve minutes from the meeting on May 23, 2016. 6. Receive reports and/or minutes from the following boards, commissions, and committees: a. Paris Public Library Advisory Board (4 -20 -2016) b. Board of Adjustment (11 -17 -2015 & 4 -19 -2016) c. Planning & Zoning Commission (4 -4 -2016) 7. Approve a Resolution Designating Authorized Signatories for Contractual Documents and Documents for Requesting Funds pertaining to the Texas Capital Fund Program (TCF) Contract Number 7215182. 8. Approve a Resolution adopting a Citizen Participation Plan and Grievance Procedures; adopting a Section 3 Policy regarding Job Training, Employment and Contracting Opportunities for Section 3 Residents; adopting a Section 504 Policy and Grievance Procedures relating to Nondiscrimination based on Handicap in Federally Assisted Activities; reaffirming Resolution 2015 -018 approving a Policy Against the Use of Excessive Force during Non - violent Civil Rights Demonstrations; reaffirming the Proclamation of April, 2016 as "Fair Housing Month" in the City of Paris, Texas; Designating a Civil Rights Officer; all as required by TxCDBG Main Street Program from the Texas Department of Agriculture (TDA); making other findings and provisions related to the subject; and providing an effective date. 9. Authorize final payment in the amount of $22,753.29, close out the contract with Rick Billy Industrial Services (RBIS) for Phase III of the water system replacement projects; and close out the loan with the Texas Water Development Board Phase III Project #62525 CID 003. Regular Agenda 10. Discuss and act on an Ordinance Disannexing three tracts of land being 1.16 acres, 2.45 acres and 160.7 acres for a total of 164.31 acres in size located in the southeastern corner of the Chisum Abstract #175 and the northeastern corner of the Bourland Abstract #70 which is 0.75 miles northwest of the intersection of FM Hwy 79 and NW Loop 286, with the 1.16 acre and 160.7 acre tracts being located along the north side of FM Hwy 79 and the 2.45 acre tract being located along the south side of FM Hwy 79and consisting of addresses ranging from 3194 FM Hwy 79 to 3930 FM Hwy 79, of the City of Paris, Lamar County, Texas. 11. Conduct a public hearing, discuss and act on an Ordinance considering the petition of Franz Thiessen on behalf of Lee Larue Trustee Estate of Billy Larue for a change in zoning from Commercial District (C) and Single - Family Dwelling District No. 2 (SF -2) to a Commercial District (C) with a Specific Use Permit (55 -Self Storage /Mini Warehouse), on Lot 10, of City Block 316, located at 3380 N.E. Loop 286. 12. Conduct a public hearing, discuss and act on an Ordinance considering the petition of Wayne Brown on behalf of Gerald and Lisa Fulton for a change in zoning from Agricultural District (A) to a Multi - Family Dwelling District No. 2 (MF -2) on Tract -63, A208 E Crow Survey, located at 4310 Pine Mill Road. 13. Receive construction update report from EST, Inc. regarding construction management and inspections for the 2013 bond project. 14. Discuss and act on a contract with Birkoff, Hendricks & Carter, LLC for engineering services on the Texas Capital Fund Main Street Project, for construction of downtown sidewalk improvements. 15. Discuss a request from the Trail de Paris Steering Committee regarding a procedure for transferal of funds collected through the city water billing accounts and provide direction to staff. 16. Receive presentation and discuss operations plan and budget needs for Public Works, Engineering, Utilities, and Finance Departments including a Public, Educational & Government Channel (PEG) and public information program. 17. Receive update for the clean-up of ditches that were in the areas of recent flooded areas, including a timeline present for when trash, brush, dirt, etc. will be removed from the current ditches; and a detailed plan. 18. Convene into Executive Session pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflict with this chapter, as follows: Glick d/b /a Tri -State Iron & Metal v. City of Paris. 19. Reconvene into Open Session and possibly take action on those matters discussed in Executive Session. 20. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004 -081. 21. Adj ournment.
