SUBJECT: TWDB PHASE III
DATE: June 17, 2016
BACKGROUND: At its July 13 meeting the city council approved accepting final payment and
closing out of the 2013 Texas Water Development Board low interest loan program, including
accepting all completed construction.
STATUS OF ISSUE: In order to formalize the closure of the loan program, the TWDB requires
approval of the attached resolution which they have provided for council action.
BUDGET: NA.
RECOMMENDATION: Approve attached TWDB resolution.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
RATIFYING THE APPROVAL OF FINAL PAYMENT AND CLOSEOUT OF THE
TEXAS WATER DEVELOPMENT BOARD "TWDB" CONTRACT #62525 CID
003 FOR THE CONSTRUCTION OF PHASE III WATER SYSTEM
REPLACEMENT WITH RBIS, LLC OF TEXARKANA, TEXAS IN THE
AMOUNT OF TWENTY TWO THOUSAND SEVEN HUNDRED FIFTY THREE
DOLLARS AND 29/100 ($22,753.29); MAKING OTHER FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, on June 22, 2015 the City of Paris entered into TWDB Contract #625825
CID 003 for the construction of Phase III Water system Replacement with RBIS, LLC of
Texarkana, Texas; and,
WHEREAS, on April 11, 2016, the City of Paris staff and consulting Engineer, Hayter
engineering, Inc., certified that the work of the contract was complete and ready for final
payment and that it was completed in conformance with the contract documents, plans,
specifications and Change Order #2 and Final; and,
WHEREAS, the construction contractor, RBIS, LLC of Texarkana, Texas has certified
that they have met all contractual obligations; and
WHEREAS, the one -year warranty begins on April 1, 2016 and ends at midnight on
March 31, 2017 as provided in the provisions of the contract documents; and
WHEREAS, the final contract amount is $381,376.20 after change order and
reconciliation of final quantities; and
WHEREAS, the remaining monies due RBIS, LLC is ready for final payment upon the
City of Paris' receipt of funds and approvals from the Texas Water Development Board in
the amount of TWENTY TWO THOUSAND SEVEN HUNDRED FIFTY THREE DOLLARS AND
29/100 ($22,753.29); and
WHEREAS, the City Council accepted the contract and approved final payment at its
regular meeting on June 13, 2016;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby
in all things approved.
Section 2. That the Contract was officially accepted and final payment was
approved by the City Council at its regular meeting on June 13, 2016, and the same is
hereby ratified.
Section 3. That this resolution shall be effective from and after its date of passage.
