05/31/2016 MINUTESMINUTES SPECIAL MEETING CITY OF PARIS BOARD OF ADJUSTMENT CITY OF PARIS - CITY HALL COUNCIL CHAMBERS CONFERENCE ROOM PARIS, TEXAS TUESDAY, MAY 31, 2016 12:00 O'CLOCK P.M. 1. The Board of Adjustment meeting was called to order by David Hamilton, Chairman at 12: 00 p. m. A. The following members were present: David Hamilton, Marilyn Smith and Louise Hagood B. The following members were absent: Jerry Haning and Deanna Manning C. Also present was Ashley Fendley, City Staff; Sue Lancaster, City Council; and Concerned Citizens 2. Approval of minutes from previous meetings. (April 19, 2016) Motion was made by Louise Hagood, seconded by Marilyn Smith to approve minutes for the April 19, 2016 meeting. Motion carried 3 -0. 3. Public hearing and consideration of and action on the petition of Lamar Avenue Church of Christ on all of Lot 1, City Block 314, being located at 3535 Lamar Avenue. A. Section 28 -6 (a) (1) of the Sign Ordinance which provides that "Billboards shall be permitted in areas zoned Light Industrial (LI) and Heavy Industrial (HI). A request for a zoning change shall not be accepted solely for the purpose of installing a billboard. No billboard shall be permitted in areas zoned as scenic or historic overlay. " The applicant's property is zoned Commercial (C) and Single- Family Dwelling District No. 2 (SF -2). B. Section 28 -6 (d)(1) of the Sign Ordinance which provides that "No billboard shall be permitted on any property that is located inside Loop 286 " The applicant's property is located inside Loop 286 C. Section 28 -6 (d)(2) of the Sign Ordinance which provides that "No billboard shall be permitted within two thousand (2, 000) feet of another billboard to the closest supporting pole of the proposed billboard. " The applicant's proposed billboard is within two thousand (2,000) feet of another billboard. D. Section 28 -6 (d) (5) of the Sign Ordinance which provides that "Except as provided herein, billboards shall not be placed within five hundred (500) feet of other permanent signs. " The applicant's proposed billboard is within five hundred (500) feet of other permanent signs. E. Section 28 -6 (d) (7) of the Sign Ordinance which provides that "No part of a billboard shall be located closer than one thousand (1, 000) feet to any property zoned or used for residential purposes, nor closer than three hundred (300) feet to any hotel, motel, nursing home, or other property used for sleeping or lodging purposes. " The applicant's proposed billboard is within one thousand (1, 000) feet of a residential zoning district and within three hundred (3 00) feet of a hotel. F. Section 28 -6 (d)(8) of the Sign Ordinance which provides that "No portion of a billboard shall be located closer than fifteen (15) feet to the right -of -way for existing streets or highways, or those projected in the city's thoroughfare plan. " The applicant's proposed billboard is approximately within the fifteen (15) feet from the right -of -way. Public hearing was declared open. A. Four individual spoke in favor of the petition. Jimmy Parker, 23478 I -30 Bryant, Arkansas, spoke in favor of the petition. Mr. Parker stated that he represents the Everett Family owners of Toyota. We are looking to place a billboard on the church property. The billboard wouldn't be for lease space it would provide ads for Evertt Toyota, Paris Church of Christ, Red Cross, Schools, Lamar County Chamber of Commerce and the City of Paris. Mr. Parker stated they understand that they are asking for several variances but there are existing signs inside the loop. Mr. Parker further stated he hopes the board will approve the variances to build the first of its kind in the City of Paris. Richard Peace, 3535 Lamar Avenue Paris, Texas, spoke in favor of the petition. Mr. Peace stated the Board of Trustees at the Lamar Avenue Church of Christ is in favor of providing the property to construct the billboard. Jim Bell, 2221 Lamar Avenue Paris, Texas, spoke in favor of the petition. Mr. Bell stated that he represents the owners of the Paris Towne Center. Mr. Bell stated they encourage the board to approve the variances. Steven Gerald, 3410 Audubon Road, Paris, Texas, spoke in favor of the petition. Mr. Gerald stated this billboard would be a great access to the city. Mr. Gerald stated that it would be a great opportunity to spread the word for events. Mr. Gerald further stated that it would of great value to our community. B. Two individuals spoke in opposition of the petition. Sue Banks, 3450 Robin Road Paris, Texas, spoke in opposition of the petition. Mrs. Banks stated that she has lived at her residence for thirty -eight years and wants to keep the neighborhood clean. Mrs. Banks stated that there are already safety issues in this location with traffic. Mrs. Banks stated she believes that the sign would make the safety issues worse. Ray Banks, 3450 Robin Road Paris, Texas, spoke in opposition of the petition. Mr. Banks stated that the existing billboards that are not up to code per the new ordinance are grandfathered in. Mr. Banks stated that he believes that the city has ordinance for reasons and the he hopes the board denies the application. Public hearing was declared closed. Motion was made by Louise Hagood, seconded by David Hamilton to deny the variance request. Motion carried 2 -1, with Marilyn Smith in opposition. This vote does not meet the requirements of the Zoning Ordinance of the City of Paris, Section 16 -300, and therefore is not a final determination.
