AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO
TRANSFER UNENCUMBERED FUNDS FROM VARIOUS DEPARTMENTS TO
OTHER DEPARTMENTS WHICH ARE EXPECTED TO OVER - EXPEND
THEIR ORIGINAL BUDGET APPROPRIATIONS; MAKING OTHER
FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A
REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, certain expense departments in the 2015 -16 fiscal year budget have
anticipated expenditures in excess of original budget appropriations in the amounts shown
therein as follows:

WHEREAS, the following departments have unencumbered appropriation balances
in the amounts shown therein as follows:

WHEREAS, in accordance with Section 70 of the Paris City Charter at the request of
the City Manager, the City Council may approve transfer of an unencumbered
appropriation balance or portion thereof from one office, department, or agency to
another;
WHEREAS, on May 16, 2016, the City Council voted to reduce required general fund
reserves from five (5) months operating expenses to four (4) months operating expenses to
free up approximately $1,800,000.00 for use in a City -wide drainage improvement plan;
and
WHEREAS, the budget for the fiscal year 2015 -2016 included funds in the amount
of $320,000.00 in the water and sewer fund for professional engineering services for
conceptual design related to rehabilitation of the City's wastewater treatment facility; and
WHEREAS, on January 25, 2016, the City Council chose not to move forward with
said conceptual design study and directed the staff instead to focus on repairing those
areas of the wastewater treatment facility where the City might be fined and to correct
other very important areas that can be funded in conjunction with the annual operating
budget;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. The findings set out in the preamble to this ordinance are hereby in all
things approved.
Section 2. The Director of Finance be, and he is hereby, authorized and directed
to transfer unencumbered appropriation balances from the following accounts in the
amounts shown as follows:

Section 3. The Director of Finance be, and he is hereby, authorized and directed
to transfer the sum of $1,800,000.00 from the general fund reserves to the capital projects
fund for the purpose of funding the City -wide drainage improvement plan.
Section 4. The Director of Finance be, and he is hereby, authorized and directed
to transfer the sum of $320,000.00 from the water and sewer fund to the capital projects
fund.
Section 5. All provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 6. The repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 7. It is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 8. That this ordinance shall become effective after its passage and
publication as required by law.
