SUBJECT: PRIVATE TAX RE -SALES
DATE: October 18, 2016
BACKGROUND: Through a previously rarely used provision of state law, The Pounders Law
Firm has arranged for the private sale of five tax delinquent properties that failed to get bids
during previous public tax sales.
STATUS OF ISSUE: Two trustee tax properties will be sold to Randall and Sheila Puetz for a
total of $500.00; one trustee tax property will be sold to Tony Perry for a total of $1,300.00; and
two trustee tax properties will be sold to Wachelle Williams for $950.00. These sales will move
five properties from the city's care to private maintenance, and at the same time place them back
on tax rolls.
BUDGET: The city will receive unbudgeted revenue of 2,750.00.
RECOMMENDATION: Approve resolutions authorizing the private re -sale of tracts of trustee
tax properties.

A RESOLUTION APPROVING THE PRIVATE RE -SALE OF TWO TRACTS OF
TRUSTEE TAX PROPERTIES (LCAD NO. 11153 - EAST PARK ADDITION,
BLOCK O, LOT 14, and LCAD NO. 11157 - EAST PARK ADDITION, BLOCK
O, LOT 18 -20, 1391 NE 12TH) TO RANDALL AND SHEILA PUETZ FOR
$500.00, AND AUTHORIZING THE MAYOR TO EXECUTE DEED
WHEREAS, 65 tracts of real property (the "Trustee Properties ") were bid off to the City of
Paris as Trustee for itself, Lamar County, Paris ISD and Paris Junior College at a public tax sale
conducted on January 6, 2015; and
WHEREAS, Texas Property Tax Code Section 34.05(i) provides that the Trustee Properties
may be sold by private sale in lieu of a public sale under Texas Property Tax Code Section 34.05(c)
& (d) with the approval of all taxing units entitled to receive proceeds from the sale, being the City
of Paris, Lamar County, Paris ISD and Paris Junior College; and
WHEREAS, a private offer to purchase two of the Trustee Properties has been received by
the City of Paris (the "Private Sale ");
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of Paris, Texas,
that:
Section 1. The offer of Randall and Sheila Puetz, 1421 NE 12th Paris, TX 75460 to purchase
the following tracts of real property for a total of $500.00 ($250.00 each) is accepted and the
Private Sale is hereby approved:
• LCAD No. 11153 -EAST PARK ADDITION, BLOCK 0, LOT 14, and
• LCAD No. 11157 -EAST PARK ADDITION, BLOCK O, LOT 18-20,1391 NE 12TH
Section 2. Subject to the Private Sale also being approved by Lamar County, Paris ISD and
Paris Junior College, the Mayor is hereby authorized to execute a tax deed conveying the Re -Sale
Properties to the Purchaser or designee. Any prior approval to re -sell this Trustee Property is
hereby withdrawn.
Section 3. The proceeds of the Private Sale shall be distributed in accordance with the
Texas Property Tax Code and the orders of the District Courts of Lamar County, Texas.

hereby withdrawn.

& (d) with the approval of all taxing units entitled to receive proceeds from the sale, being the City
of Paris, Lamar County, Paris ISD and Paris Junior College; and
