2000-062-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARIES ESTABLISHED BY ZONING MAP OF SAID CITY ON LOT 1 CITY BLOCK 276 ON PROPERTY BELONGING TO DON ENSEY ORDINANCE NO, 2000-062 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY ; ESTABLISHING A LIGHT INDUSTRIAL DISTRICT (LI) ON LOT 1, CITY BLOCK 276, ON PROPERTY BELONGING TO DON ENSEY, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A ONE-FAMILY DWELLING DISTRICT NO.2 (SF-2); DESIGNATING THE BOUNDARIES OF THE LIGHT INDUSTRIAL DISTRICT (LI) SO ESTABLISHED; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE OF JANUARY 1, 2001. WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Planning and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and State law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Counci I of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan ofthe City of Paris, consistent with the City zoning ordinance, and in the best interests and to the benefit ofthe public health, safety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this ordinance are hereby in all things approved, Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No, 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a LIGHT INDUSTRIAL DISTRICT (LI) be, and the same is hereby, established on LOT 1, CITY BLOCK 276, on property belonging to DON ENSEY, so as to include in such LIGHT INDUSTRIAL DISTRICT (LI) the hereinafter described property, which was formerly and is presently designated as a ONE-FAMILY DWELLING DISTRICT NO.2 (SF-2), and that the boundaries of said LIGHT INDUSTRIAL DISTRICT (LI), be, and the same are hereby, established as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and State of Texas, being a part of the Reddin Russell Survey #786, being Lot I, City Block 276, and being a part of a called 19,75 acre tract ofIand conveyed A. J, Varner by deed recorded in Volume 250, Page 4 I I, of the Deed Records of said County and State, and being more particularly described as follows: BEGINNING at a capped (JMN - 4025) iron pin (s) for corner at the northwest corner of said 19.75 acre tract, said point being in the south boundary line of a called 64,82 acre tract of land conveyed Dixie Ann Payne Harlan by deed recorded in Volume 365, Page 195, of the Deed Records of said County and State; THENCE South 60010'53" East along a partial fence along the north boundary line of said 19,75 acre tract a distance of 1304,34 feet to a capped (JMN - 4025) iron pin (s) for corner at the southeast corner of said 64,82 acre tract, said point being a southwest corner of a called 4,841 acre tract of land conveyed McDonald Company by deed recorded in Volume 5, Page 271, of the Real Property Records of said County and State, said point also being the northwest corner of a 1,857 acre tract of land surveyed out of said 19.75 acre tract ofland on this same day; THENCE South 21004'32" West a distance of 393.53 feetto a capped (JMN - 4025) iron pin (s) for corner at the southwest corner of said 1.857 acre tract; THENCE along the north boundary line of Clement Road as follows: South 89039'38" West a distance of 557,69 feet; South 89041'39" West a distance of 195,19 feet to the southeast corner of a called 1.596 acre tract of land conveyed out of said 19,75 acre tract to Marcella Varner Matney by deed recorded in Volume 643, Page 30, of said Real Property Records; THENCE North 3039'18" East at 0,55 feet passing an iron pin (f), and continuing on along a fence a total distance of 258,80 feet to an iron pin (f) for corner at the northeast corner of said 1,596 acre tract; THENCE North 83021'03' West along a fence a distance of 262,46 feet to a capped (JMN - 4025) iron pin (frs) for corner at the northwest corner of said 1.596 acre tract; THENCE North 0032'30' East along the east boundary line of 9th Street N.E, a distance of 731.51 feet to the place of beginning and containing 15.946 acres of land, and being located in the 1100 block of Clement Road. Section 3. That the Chief Building Official ofthe City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No, 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance, Section 4. That any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense, Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed, Section 6. That this ordinance shall become effective January 1,2001.
