SUBJECT: DESIGNATION OF AN OFFICIAL NEWSPAPER FOR THE CITY OF
PARIS

BACKGROUND: Texas Local Government Code Section 52.013 provides for publication of
the captions and penalties or ordinances by home rule municipalities. In addition, Section 33 of
the Charter requires the publication of the caption or title, including the penalty, of all ordinances
to be published in the "official newspaper" of the City of Paris at least twice within ten days of
passage within ten days.
STATUS OF ISSUE: The City of Paris has been publishing notices in the Paris News for many
years, primarily because it meets all of the criteria legally required by the State for an officially
designated newspaper.
BUDGET: There will be no impact, because publications are already budgeted.
RECOMMENDATION: Approve a Resolution designating Paris News as the Official
Newspaper for the City of Paris.
RESOLUTION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS DESIGNATING
AN OFFICIAL NEWSPAPER FOR THE CITY OF PARIS FOR FISCAL YEAR 2016 -2017;
MAKING OTHER FINDINGS AND PROVISIONS AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Sec. 33 of the Charter of the City of Paris, Texas, a home rule
municipality, requires the publication of the caption or title, including the penalty, of all
ordinances to be published in the "official newspaper' of the City of Paris at least twice
within ten days of a passage of said ordinances; and
WHEREAS, Texas Local Government Code Sec. 52.013 also provides for the
publication of the captions and penalties of ordinances by home rule municipalities; and
WHEREAS, the City Council finds that the Paris News is a paper of general
circulation within the City of Paris; and
WHEREAS, the Paris News: (1) devotes not less than 25% of its total column lineage
to general interest items; (2) is published at least once each week; (3) is entered as 2nd
class postal matter in the county where published; and (4) has been published regularly
and continuously for at least 12 months before the governmental entity or representative
publishes notice, in conformance with the requirements of Texas Government code Sec.
2051.044; and
WHEREAS, the City Council finds that the Paris News is a publication that meets all
of the criteria legally required of an officially designated newspaper for the City of Paris.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS, THAT:
Section 1. The findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. The City of Paris shall pay all applicable fees for its publications in the
Paris News as agreed upon between the City of Paris and the Paris News.
Section 3. Until September 30, 2017, the City of Paris shall continue to publish in
The Paris News each notice or other matter required to be published by law.
Section 4. Until September 30, 2017, the City of Paris may publish in the Paris
News notices and other matters required to be published by law and which do not require
publication in the official newspaper.
Section 5. This Resolution shall become effective immediately upon its passage.
