11/09/2016 MINUTESREGULAR MEETING MINUTES CITY OF PARIS HISTORIC PRESERVATION COMMISSION CITY COUNCIL CHAMBERS 107 EAST KAUFMAN PARIS, TEXAS WEDNESDAY NOVEMBER 9, 2016 Present: Chris Dux -Chair Sarah Barbee- Vice Chair David Alarid Skipper Steely City Staff: Ashley Fendley Robert Talley Absent Leah Rolen Linda Knox Pat Conrad Matt Frierson, Council Liaison Guests Matt Coyle Vicki Olsen 1. Chairman Dux called the meeting to order at 4:02 p.m. 2. Approval of minutes from the October 12, 2016 meeting. Commissioner Alarid made the motion to approve the minutes, seconded by Commissioner Steely; Motion carried 4 — 0. 3. — CONSENT AGENDA - -- Discussion and possible action regarding the following structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures," to determine whether such buildings or structures can be rehabilitated and designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris. Code Enforcement Supervisor Robert Talley presented the following houses for demolition: A. 1421 W. Cherry B. 1990 W. Shiloh C. 408 N.E. IOt' D. 815 N.E. 7" Commissioner Steely requested all items be pulled from the consent agenda, but then agreed that items B & D should be demolished because they were burned. Commissioner Steely said he wanted to table the other items until the commission could come up with a plan. Commissioner Dux advised the other commissioners it is not necessary to remove items from the consent agenda that could remain, and asked Commissioner Steely if he was agreeable to leaving items B & D on the consent agenda. Commissioner Steely agreed. A motion was made by Commissioner Steely to send items B & D to the Building and Standards Commission for action since the buildings have no historical value and cannot be rehabilitated, seconded by Commissioner Alarid, Motion Carried 4 -0 Discussion on item A, 1421 W. Cherry: Commissioner Steely stated the house was in bad shape, but also noted there were two others around the house that are in just as bad shape. Commissioner Steely made a motion to save the structure until there is a plan. Commissioner Dux asked Commissioner Steely to clarify who he wants to have a plan. Commissioner Steely said he wanted to see the City of Paris have a master plan to go through the blocks, before he would vote yes on any other houses being demolished. Commissioner Dux reminded all Commissioners that Historic Preservation Commissions responsibilities are to determine whether the structure has any historical significance that deems it worthy of saving, and if so, the Historic Preservation Commission must come up with a plan on rehabilitation. Commissioner Steely said he wants to vote not to send the house to the Buildings and Standards. Commissioner Alarid then stated that he would vote not to send the house, because the piecemeal abating of federal law is unacceptable and breaking the spirit of the law. He commented, "The spirit of the law says do the abating first, and Robert says if he does S houses we can forget federal law, if we do more than that we have to follow. " Commissioner Alarid mentioned the city should follow all of the law and not break the spirit of the law of the abatement, because when the buildings are being demolished everybody's health is in danger. Commissioner Dux then asked if there is a motion to save item A because of its historical significance and if so, please indicate what is the historical significance. Commissioner Alarid asked if the commissioner had any proof if it is historical. He didn't know, but it looked old to him. Commissioner Dux stated it was up to the commission to determine this. Commissioner Barbee made the motion to table item A until the next meeting, seconded by Commissioner Steely, Commissioner Dux asked for any discussion before going to a vote. Robert Talley, Code Enforcement reminded the commission that the two structures are unsecure, an attractive nuisance, and dangerous, and this is why they have been placed on the list to go to buildings and standards commission. They have to go to buildings and standards before there can be an order on them, even if the order was to secure them. He informed the commission that both of the structures' roofs are collapsing. He reminded them if they intend to table it, the commission would be leaving a dangerous structure in the city and prolonging the process. He is recommending they go to Buildings and Standards for demolition because of their dangerous condition so Building and Standards commission can make a decision. Hearing no other discussion Commissioner Dux called for a vote. Motion carried 3 — 1, Commissioner Dux dissenting. Discussion on Item C, 408 NE IO`h Street. Commissioner Steely asked if there was a background on the house. Robert Talley told the commission that the house had been to Building and Standards and ordered to repair. The owner (Mrs. Canister) has since passed away and didn't complete all the repairs and now others removing the boards. Commissioner Dux asked that if there was a previous order to repair, does it continue until the commission makes a different decision. Commissioner Steely asked to see the deed history, and noted the other houses across the street are in disrepair. Commissioner Steely asked how this house got on the agenda. Robert Talley stated he discovered its condition in route to another case. Commissioner Steely stated once again that he still thinks there should be a system for the City to claim the houses and put them up for sale before they fall apart. There was some discussion on the acquisition of personal property by government entities. Commissioner Dux suggested training on what the laws and rules are for a city acquiring property before it goes into disrepair. Commissioner Steely stated that he wanted the city attorney to come and discuss this with them. Commissioner Alarid asked if the building was structurally sound except for the hole in the roof. Robert Talley said that it has a hole in the roof possibly from a limb falling through the roof. Commissioner Alarid asked if the reason to red tag it was because of the hole in the roof, and recommended tabling it for the same reasons as stated in item A. Commissioner Dux asked for discussion. Hearing none, a motion was made to table the structure to the next meeting by Commissioner Alarid; seconded by Commissioner Steely. Motion Carried 3 — 1, Commissioner Dux dissenting. 4. Discussion and Action on the following Certificates of Appropriateness: A. COA #2016 -48 250 Bonham Street: Demolition of structure, Jack Hilliard. Vicky Olsen represented Jack Hilliard, and stated it was not feasible to repair the building. She stated the east side was hadite blocks and the south facing side is garage doors. She stated there were not any plans for infill. She stated the inside of the building is falling completely apart, and there are some large display cases. The commissioners discussed the age of the building, and it was determined that it was built in the 1960s. Commissioner Steely made the motion to approve demolition of the structure, seconded by Commissioner Alarid. There being no other discussion, the motion carried 4 — 0. B. COA #2016 -49 425 S. Church Street: Fence, Don Pryor. In the absence of a representative, the commission discussed the design standards. Chain link is not allowed, and there is a precedent already set for denial of chain link. Commissioner Alarid made the motion to deny the Certificate of Appropriateness and discuss other alternatives with Mr. Pryor. Motion seconded by Commissioner Barbee. There being no other discussion, the motion carried 4 — 0. C. COA # 2016 -50 7 S. Plaza: Fagade Repair/Replacement, Matt Coyle. Mr. Coyle explained there was a lot of deterioration on the front of 7 Plaza, and the plan is to remove the hardy board from the 1990's and use a stone veneer, install an awning to keep a consistent look, and work on keeping the front weatherproof. Commissioner Dux asked if there was consideration of replacement with newer material similar to hardy board. Commissioner Barbee made the motion to approve the stone veneer, Commissioner Steely seconded, and the chair called for discussion. Commissioner Dux would prefer that the owner go back with a more historic hardy board look. There being no other discussion, the motion Carried 4 — 0. 5. Discussion and Possible Action on the Facade Grant Application. 7 South Plaza: Matt Coyle A motion was made to approve up to a $2,500 grant for the Fagade Replacement and repair by Commissioner Alarid, Seconded by Commissioner Steely; motion carried 4 — 0. 6. Review on Design Standards: This item was tabled to the next meeting. A. David Alarid Architectural Heritage and Development Pages 36 -39. B. Skipper Steely - Styles and Influence Pages 40 — 44. HPO Report: Commissioners asked where the house was located and who owned it. No other questions were asked. COA #2016 - 047 -Roof replacement 1220 S. Main Street. 7. Future Agenda items: Commissioner Steely asked for city attorney to come to the meeting and explain the acquisition of houses, Commissioner Steely also requested discussion on the First National Bank building. 8.
