AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE
CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES
ESTABLISHED BY THE ZONING MAP OF SAID CITYj ESTABLISHING
A COMMERCIAL DISTRICT (C) ON PART OF LOTS 13, 14, 27, 28, AND
A PORTION OF A 15 FOOT WIDE ALLEY, BLOCK 1 OF THE WARREN
ADDITION, ON PROPERTY BELONGING TO GARY NASH, SO AS TO
INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A
GENERAL RETAIL DISTRICT (GR) AND ONE-FAMILY DWELLING
DISTRICT NO.2 (SF-2)j DESIGNATING THE BOUNDARIES OF THE
COMMERCIAL DISTRICT (C) SO ESTABLISHEDj PROVIDING FOR A
PENALTY NOT TO EXCEED $2,000.OOj REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING FOR AN EFFECTIVE DATE O}' AUGUST 1, 2000.
WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received
a request for an amendment to the zoning ordinance of the City of Paris; and,
WHEREAS, the City Council has subsequently referred said request for amendment to
the Planning and Zoning Commission for its review and recommendation in accordance with the
City zoning ordinance and State law; and,
WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said
proposed amendment to the City zoning ordinance and, following said hearing, made formal
recommendation to the City Council regarding said proposed change; and,
WHEREAS, the City Council of the City of Paris did subsequently conduct a public
hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered
the recommendations of the Planning and Zoning Commission and the testimony and evidence
introduced at said public hearing, found and determined that approving the aforesaid zoning
change would be consistent with the comprehensive plan of the City of Paris, consistent with the
City zoning ordinance, and in the best interests and to the benefit of the public health, safety, and
welfare of the citizens of the City of Paris; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:
Section 1. That the findings set out in the preamble of this ordinance are hereby in all
things approved.
Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance
No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a
COMMERCIAL DISTRICT (C) be, and the same is hereby, established on PART OF LOTS 13,
14,27,28, AND A PORTION OF A 15 FOOT WIDE ALLEY, BLOCK I OF THE WARREN
ADDITION, on property belonging to GARY NASH, so as to include in such COMMERCIAL
DISTRICT (C) the hereinafter described property, which was formerly and is presently designated
as a GENERAL RETAIL DISTRICT (GR) AND ONE-FAMILY DWELLING DISTRICT NO.
2 (SF-2), and that the boundaries of said COMMERCIAL DISTRICT (C), be, and the same are
hereby, established as follows:
SITUATED within the corporate limits of the City of Paris, County of
Lamar, and State of Texas, being a 0.748 acre tract of land situated in the Asa
Jarman Survey, Abstract No. 473, being a portion of that certain tract of land
conveyed to the Southland Corporation by deed recorded in Volume 651, Page
734, Lamar County Deed Records, and being a portion of Lots 13, 14,27, and 28
and a portion of a 15 foot wide alley, Block 1, Warrens Addition, as recorded in
Volume 70, Page 367, Lamar County Plat Records, and being more particularly
described by metes and bounds as follows:
BEGINNING at a 4" iron at the intersection of the south boundary line of
Maple Avenue (a 40 foot ROW) with the east boundary line of 19th Street N.W.
(a 50 foot ROW);
THENCE N 88 Deg. 27 Min. E along the south boundary line of said
Maple A venue a distance of 85.00 feet to a 4" iron at the northwest corner of said
Lot 28, Block 1;
THENCE S 00 Deg. 28 Min. E along a fence and along the west boundary
line of said Lot 28 a distance of 81.00 feet to a fence corner;
THENCE N 87 Deg. 57 Min. E continuing along said fence a distance of
66.00 feet to a 4" iron;
THENCE S 00 Deg. 28 Min. E continuing along said fence a distance of
10.00 feet to a 4" iron;
THENCE N 89 Deg. 57 Min. E continuing along said fence a distance of
54.00 feet to a 4" iron in the east boundary line of Lot 27 and the west boundary
line of Lot 26, said Block 1;
THENCE S 00 Deg. 28 Min. E continuing along said fence and along the
common line of said Lots 26 and 27, passing a 15 foot wide alley and continuing
along said fence and along the common line of said Lot 13 and Lot 12, said Block
1, in all a distance of 230.61 feet to a 4" iron in the north boundary line of
Bonham Street (a 60 foot ROW);
THENCE West along the north boundary line of said Bonham Street a
distance of 53.08 feet to a 4" iron;
THENCE N 09 Deg. 15 Min. W a distance of 81.19 feet to a 4" iron;
THENCE N 00 Deg. 09 Min. E a distance of 81.10 feet to a 4" iron;
THENCE N 89 Deg. 51 Min. Wa distance of 141.40 feet to a 4" iron in
the east boundary line of said 19th Street N.W.;
THENCE N 00 Deg. 06 Min. Walong the east boundary line of said 19th
Street N.W. a distance of 157.60 feet to the point of beginning and containing
0.748 acre (32,580 square feet) of land, being located in the 1800 block of Bonham
Street.
Section 3. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Zoning Map of the City of Paris in accordance with the provisions of
Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the
provisions of this ordinance.
Section 4. That any person violating any of the provisions of this ordinance shall be guilty
of a Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and
each and every day's continuance of any violation of the above-enumerated sections shall
constitute and be deemed a separate offense.
Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby
expressly repealed.
Section 6. That this ordinance shall become effective August I, 2000.
PASSED AND ADOPTED by the City Council of the City of Paris, in regular session
convened, in the Council Chambers, City Hall, Paris, Texas, on this the 6th day of July, 2000.
