2000-032-ORD AMENDING ZONING ORDINANCE NO 1710 AND CHANGING BOUNDARIES ESTABLISHED BY ZONING MAP OF SAID CITY ON LOT 12 CITY BLOCK 259 ON PROPERTY BELONGING TO GARY NASH ORDINANCE NO. 2000-032 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY THE ZONING MAP OF SAID CITY j ESTABLISHING A COMMERCIAL DISTRICT (C) ON A PART OF WT 12, CITY BWCK 259, ON PROPERTY BEWNGING TO GARY NASH, SO AS TO INCLUDE THEREIN TERRITORY FORMERLY DESIGNATED AS A PLANNED DEVELOPMENT DISTRICT - COMMERCIAL CENTER (PD-al)j DESIGNATING THE BOUNDARIES OF THE COMMERCIAL DISTRICT (C) SO EST ABLISHEDj PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.OOj REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITHj AND PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 1,2000. WHEREAS, the City Council of the City of Paris, Paris, Texas, has previously received a request for an amendment to the zoning ordinance of the City of Paris; and, WHEREAS, the City Council has subsequently referred said request for amendment to the Planning and Zoning Commission for its review and recommendation in accordance with the City zoning ordinance and Stale law; and, WHEREAS, the Planning and Zoning Commission did conduct a public hearing on said proposed amendment to the City zoning ordinance and, following said hearing, made formal recommendation to the City Council regarding said proposed change; and, WHEREAS, the City Council of the City of Paris did subsequently conduct a public hearing on the aforesaid proposed amendment to the City zoning ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the comprehensive plan of the City of Paris, consistent with the City zoning ordinance, and in the best interests and to the benefit of the public health, safety, and welfare of the citizens of the City of Paris; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble of this ordinance are hereby in all things approved. Section 2. That the boundaries heretofore established by the Zoning Map and Ordinance No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a COMMERCIAL DISTRICT (C) be, and the same is hereby, established on A PART OF LOTl2, CITY BLOCK 259, on property belonging to GARY NASH, so as to include in such COMMERCIAL DISTRICT (C) the hereinafter described property, which was formerly and is presently designated as a PLANNED DEVELOPMENT DISTRICT - COMMERCIAL CENTER (PD-al), and that the boundaries of said COMMERCIAL DISTRICT (C), be, and the same are hereby, established as follows: SITUATED within the corporate limits of the City of Paris, County of Lamar, and Slale of Texas, being a part of the Hiram Williams Survey #1003, and being a part of a part of tract 2 as conveyed by Earl D. Bellamy et ux to Lynn Newman et al by deed recorded in Volume 398, Page 37, of the Real Property Records of said County and State, and being a part of Lot 12, City Block 259, plat not recorded, and being more particularly described as follows: BEGINNING at an iron pin (f) for corner at the northwest corner of said tract 2, said point being the northeast corner of a lot owned by Richard Powell, said point also being in the south boundary line of a lot conveyed D. Garrett, et ai, by deed recorded in Volume 536, Page 84, of the Deed Records of said County and State; THENCE along the north boundary line of tract 2 as follows: North 890 57' 30" East a distance of 29.81 feet to an iron pin (f) at the southeast corner of said Garrett lot and the southwest corner of a called 6.34 acre tract of land conveyed to East Paris Baptist Church by deed recorded in Volume 203, Page 20, of said Real Property Records; South 890 29' 09" East a distance of 451.97 feet to a capped (JMN-4025) iron pin (s) for corner at the southeast corner of said 6.34 acre tract; THENCE along the westerly boundary line of N. Collegiate Drive as follows: South 410 22' 33n West a distance of 188.65 feet to a capped (JMN- 4025) iron pin (s); Southerly around a curve (R = 999.90'; C = South 240 51' 44 n West 557.58 ft.) to the left a distance of 565.07 feet to a capped (JMN-4025) iron pin (s) for corner; THENCE North 880 31' 53" West along the north boundary line of E. Cherry Street a distance of 124.92 feet to an iron pin (f) for corner at the southwest corner of said tract 2 and the southeast corner of said Powell lot; THENCE North 00 11' 50' East a distance of 648.31 feet to the place of beginning and containing 3.8450 acres ofland, or 167,487.58 sq. ft. ofland, being located in the 500 Block of N. Collegiate Drive. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Zoning Map of the City of Paris in accordance with the provisions of Ordinance No. 1710 and the land use map accompanying the same, and in accordance with the provisions of this ordinance. Section 4. That any person violating any of the provisions of this ordinance shall be guilty ofa Misdemeanor, and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated sections shall constitute and be deemed a separate offense. Section 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. That this ordinance shall become effective August 1, 2000.
