1. The meeting of the Planning and Zoning Commission on Monday, November 7, 2016, was
called to order at 5:3 O p. m. by Holland Harper, Chairman.
A. The following members were present: John Lee, Holland Harper, Robert Spain,
Jerry Akers and Chad Lindsey
B. The following members were absent: Mike Folmar and Barney Bray
C. Also present were Alan Efrussy, Planning Manager; Carla Easton, City Engineer;
Stephanie Harris, City Attorney; Steve Clifford, City Council; Triniti Frazier, City
Staff and concerned citizens.
2. Approval of minutes from previous meetings. (October 17, 2016)
Motion was made by John Lee, seconded by Jerry Akers to approve minutes for the
October 17, 2016 meeting. Motion carried 5 -0.
3. Public hearing to consider and take action regarding the petition of Evan Evans on behalf
of Sami Ebrahim for a change in zoning from Commercial District (C) to a Commercial
District (C) with a Specific Use Permit (45- Auto Fuel Sales), on City Block 170 -C, Lot 15,
being located at 2735 South Church Street.
Public hearing was declared open.
A. One individual spoke in favor.
Sam Ebrahim, Heath, Texas spoke in favor of the petition. Mr. Ebrahim stated that
he is the developer of this project. Mr. Ebrahim stated this truck stop will not have
showers it will just be fueling only. Mr. Ebrahim further stated the truck stop will
have a Taco Casa.
B. No one spoke in opposition.
Public hearing was declared closed.
Motion was made by John Lee, seconded by Chad Lindsey to approve the petition.
Motion carried 5 -0.
4. Public hearing to consider and take action regarding the petition of Jerry & Lynda
Stephens for a change in zoning from Single - Family Dwelling District No. 2 (SF -2) to a
Multi - Family Dwelling District No. 2 (MF -2), on City Block 262, Lots 8A & 12, being
located at 1240 NE 20`h Street.
Public hearing was declared open.
A. Ten individuals spoke in favor.
Chad Stephens, 3935 Miranda Drive, Paris, Texas spoke in favor of the petition.
Mr. Stephens stated he is speaking on behalf of his parents Jerry and Lynda
Stephens who have owned the property for 43 years. Mr. Stephens stated after the
garden apartments burned down and left 120 people homeless he started looking
for apartment developers. Mr. Stephens stated that in the past few months the
realtor market has been nothing like he has ever seen. Homes are being sold above
asking price and seeing multiple offers due to the high demand and shortage of
housing. With that being said and the projected developments in the near future we
cannot accommodate them. Mr. Stephens stated that we have a contract with
Hamilton Properties which have several facilities all over the state and other states.
However, it is contingent on our land being rezoned to multi - family. They are
looking to invest about 5 million dollars and they only need about 4 to 5 acres. The
size of the lot is about 12.5 acres. Mr. Stephens stated that their research of the 67
homes that surround the property 37 are renter occupied and 30 are owner
occupied, which makes it a predominant renter neighborhood. Approximately, 8
years ago a developer wanted to invest 7 to 8 million dollars for an apartment
complex and the neighborhood banded together to squash it. The estimated revenue
that the City lost was approximately 1.5 million dollars. During our committee
meeting the neighborhood stated some reasons they didn't want it. Mr. Stephens
stated he has addressed the issues and made a list of pros and cons of why it is good
for the City. Mr. Stephens stated as far as the pros it will fill the demand of the local
housing crisis, provide quality homes, new construction inside the loop, increase
tax revenue, increase safety, decrease theft and squatters, reduce the snake and
rodents, clean up the property, help with drainage issues by installing a detention
pond, provide green space around the property for privacy, jobs for contractors and
beautify the neighborhood with first class facilities. Mr. Stephens stated that he was
unable to come up with any cons to this development. Mr. Stephens further stated
that it would be great for the City, the developers and the neighborhood. Mr.
Stephen finally stated the Hamilton Properties made a great point we can invest 5
million dollars in Paris or in Waxahachie.
Jeff Hill, 480 Airport Road, Reno, Texas, spoke in favor of the petition. Mr. Hill
stated he believed this development could potentially help with the safety, lighting
and drainage issue along with the bugs and snakes.
Steve Keywood, 2602 Lamar Avenue, Suite 2A, Paris, Texas, spoke in favor of the
petition. Mr. Keywood stated he believes it would enhance the area and make it
safer.
Pat Murphy, 2523 CR 13200, Blossom, Texas, spoke in favor of the petition. Mr.
Murphy stated the flood issues will be handled in the permitting process with a
detention pond of some sort. Mr. Murphy further stated that there is no evidence of
causing loss in value for building apartments.
Mack Ross, 3465 Reno Drive, Paris, Texas, spoke in favor of the petition. Mr. Ross
stated that he has lived in Paris for over 40 years. Mr. Ross further stated this is one
of the two lots left on 201h Street for further development. Mr. Ross stated that he
would rather see apartment's versus duplexes. Mr. Ross further stated with
apartments you would only have one tap and not multiple taps.
Todd Stephens, 2910 Meandering Way, Paris, Texas, spoke in favor of the petition.
Mr. Stephens stated that he is Jerry and Lynda Stephens son. Mr. Stephens stated
that his parents have had this property for over 40 years and are just trying to sell
the property. Mr. Stephens further stated this would be a great development for the
City.
Billy Trenado, 930 Jefferson Road, Paris, Texas, spoke in favor of petition. Mr.
Trenado stated that he wishes the commission will approve the change in zoning.
Richard Drake, 6090 HWY 271, Powderly, Texas, spoke in favor of the petition.
Mr. Drake stated that to build the apartments they will have to meet all the codes
and permit requirements. Mr. Drake further stated that he is for the change in
zoning.
Sara Eatherly, 4134 Primrose Lane, Paris, Texas, spoke in favor of the petition. Ms.
Eatherly stated she has been listening to what everyone has to say about the water
issues, sidewalks, streets and other issues. Ms. Eatherly stated that this is a City
issue not Jerry and Lynda Stephens's fault they are just trying to sell the property.
Ms. Eatherly further stated that these questions can be answered by the City of Paris
Engineering Department.
Sophia Valasquez, of Paris, Texas, spoke in favor of the petition. Ms. Valasquez
stated she would like to be removed from the petition for denial and would like to
see this development.
B. Six individuals spoke in opposition.
Jim Montgomery, 1135 NE 200' Street, Paris, Texas, spoke in opposition of the
petition. Mr. Montgomery stated he has lived on 200i Street for 50 years. Mr.
Montgomery stated that this property had two houses on it. One house a gentleman
lived in with no electricity but has been burnt down. The other house has been
boarded up for over a year only because they City did it. Mr. Montgomery stated
that if they take care of the property like they have he is really scared to see what
happens. Mr. Montgomery further stated that the individuals that are speaking for
the change in zoning are either contractors or citizens that do not live in this area.
Cecil Ballard, 1130 NE 200i Street, Paris, Texas, spoke in opposition of the petition.
Mr. Ballard stated that everyone has a lot of money invested in this neighborhood.
Mr. Ballard further stated he hopes the commission will deny this development.
Cindy Thorns, 1255 NE 22"d Street, Paris, Texas, spoke in opposition of the
petition. Ms. Thorns stated she had concerns about the potential water problems
and traffic issues. Ms. Thoms further stated she wishes the commission will deny
the petition.
Constance Robinson, 1325 NE 32"d Street, Paris, Texas, spoke in opposition of the
petition. Ms. Robinson stated that she has lived in her home for 85 years. Ms.
Robinson stated that when her house was built she was not in the floodway.
However, over the years as the City grew and grew that is what put her in the
floodway. Ms. Robinson further stated that engineering need to look at what
they've created.
Virginia Allen, 1240 NE 22nd Street, Paris, Texas, spoke in opposition of the
petition. Ms. Allen stated that she is the individual that composed the petition for
denial. The petition consists of 49 owners and 51 concerned citizens. Ms. Allen
further stated that she had concerns about dangerous traffic and flooding issues.
Sandra Hill, 1235 NE 22nd Street, Paris, Texas, spoke in opposition of the petition.
Ms. Hill stated she has been a home owner in this location for 36 years and know
the problems in the area. Ms. Hill stated the major problem is the water issue.
Public hearing was declared closed.
Motion was made by Holland Harper, seconded by John Lee to approve the petition with
the following conditions a quality engineer survey, TxDOT permit and green space.
Motion carried 4 -1, with Chad Lindsey in opposition.
5. Consideration of and action on the Preliminary Plat of Lot 3, Block A, Pecan Place Phase
IV -A, located at 4300 Block of Pine Mill Road.
Carla Easton reviewed the preliminary plat with commissioners. Motion was made by John

Lee, seconded by Chad Lindsey to approve the preliminary plat. Motion carried 5 -0.
Consideration of and action on the Preliminary Plat of Lot I and 2, Block A, Rhodes 257B
Addition, located at 2531 Pine Bluff Street.
Carla Easton reviewed the preliminary plat with commissioners. Motion was made by
Chad Lindsey, seconded by John Lee to deny the final plat. Motion carried 5 -0.
Consideration of and action on the Replat of Lot 1, Block A, Oak Ridge 318 Addition,
located at 3055 N. E. Loop 286
Carla Easton reviewed the replat with commissioners. Motion was made by John Lee,
seconded by Jerry Akers to approve the replat. Motion carried 5 -0.
4. Meeting adjourned at 6:47 p.m.
