12/12/2016MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF PARIS, TEXAS December 12, 2016 The City Council of the City of Paris met for a regular session at 5:30 p.m. on Monday, December 12, 2016, at the City Council Chamber, 107 E. Kaufinan, Paris, Texas. Present: Mayor: A.J. Hashmi Council Members: Billie Lancaster; Aaron Jenkins; Billy Trenado; Steve Clifford; Matt Frierson; and Cleonne Drake City Staff John Godwin, City Manager; Stephanie Harris, City Attorney; Janice Ellis, City Clerk; Gene Anderson, Finance Director; Carla Easton, City Engineer; Larry Wright, Fire Chief; Bob Hundley, Police Chief; Kent Klinkerman, EMS Director; Doug Harris, Utilities Director; Jerry McDaniel, Public Works Director; Priscilla McAnally, Library Director; and Alan Efrussy; Planning Manager Opening Agenda Call meeting to order. Mayor Hashmi called the meeting to order at 5:30 p.m. 2. Invocation. Gene Anderson gave the invocation. 3. Pledge of Allegiance. Council Member Lancaster led the pledge. 4. A. Citizens' Forum. Keith Flowers, 305 -1St SW — he said the policy about a resident having to call a plumber for a gas inspection prior to the City turning back on the gas for a home after it was turned off for 90 days, needed to be changed. Mr. Flowers referenced senior citizens sometime turn off their gas to save money in the summer, that Atmos has to inspect it and that a citizen should not have to pay a plumber when Atmos has inspected it already. Mr. Flowers said the City of Reno does not require their citizens to hire a plumber, because if there is a problem Atmos will not allow it to be turned on. He said this was an undue financial burden on citizens. Regular Council Meeting December 12, 2016 Page 2 Louise Moseley, 3915 Shannon Drive — she said she found herself in the same predicament and was forced to pay $620.00 to a plumber to get inspections done after turning the gas off for the summer. Jim Bell, 2221 Lamar Avenue — he said there was too much red tape and anything that could be done to help citizens should be done. B. Recognition of Amanda Willows and Coleman Morris for their leadership in raising funds to purchase lifesaving equipment as part of the Lamar County Adopt -A -Cop Program. Chief Hundley informed the public that Amanda Willows and Coleman Morris were instrumental in raising donations to provide every peace officer in Lamar County with an armor vest capable of stopping high powered rifle rounds, as well as a ballistic helmet for eachofficer. Mayor Hashmi presented Ms. Willows and Mr. Morris with certificates of appreciation. Council Member Frierson arrived at 5:40 p.m. Consent Agenda Mayor Hashmi inquired of Council Members if they wished to pull any items from the consent agenda for discussion. Council Member Lancaster asked for discussion on item 9. She inquired about efforts of the badly dilapidated houses around the West Trail. City Manager John Godwin said that was a priority recently given to Robert Talley. A Motion to approve the consent agenda was made by Council Member Lancaster and seconded by Council Member Clifford. Motion carried, 7 ayes — 0 nays. 5. Approve minutes from the meeting on November 14, 2016. 6. Receive reports and/or minutes from the following boards, commissions, and committees: a. Approve RESOLUTION NO. 2016 -034: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS DESIGNATING AN OFFICIAL NEWSPAPER FOR THE CITY OF PARIS FOR FISCAL YEAR 2016 -2017; MAKING OTHER FINDINGS AND PROVISIONS AND PROVIDING AN EFFECTIVE DATE. 11. Approve the Final Plat of Lot 1, Block A, Paris /Lamar County Habitat Addition 51, located at 934 Dickson Avenue. 12. Authorize the city manager to issue a letter of support of the JRB Regional Coordination Committee's efforts to implement effective land use planning near military bases. 13. Authorize change order 3, authorize final payment in the amount of $156,615.15, close out Contract B2 Utilities Project with Pittard Construction, and accept improvements. 14. Approve RESOLUTION NO. 2016 -036: A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, DESIGNATING AUTHORIZED SIGNATORIES FOR CONTRACTUAL DOCUMENTS AND DOCUMENTS FOR REQUESTING FUNDS PERTAINING TO THE TEXAS COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ( TXCDBG) CONTRACT NUMBER 7216361. 16. Approve a contract with Birkoff, Hendricks & Carter LLC (BHC) to provide engineering services for the Dixon Orange Infrastructure Improvements project. Regular Council Meeting December 12, 2016 Page 4 Regular Anenda 17. Receive input from citizens, discuss and act on a presentation regarding streets bond projects. Mayor Hashmi said his presentation was simply suggestions as a result of the annexation of PJC by the County. He confirmed with Finance Director Gene Anderson that PJC was projecting they would drop their tax rate by .08. Mayor Hashmi inquired of Mr. Anderson the effect on the City's bond rating if the City sold certifications of obligations. Mr. Anderson said based on the two bond ratings, the City could manage it. Mayor Hashmi explained that over the years the roads in Paris had deteriorated due to finances and other important projects, such as the water and sewer bond project. He said if the City continues to ignore this very serious issue that over time the roads will only become worse and a huge bond would be needed to address the problem. He outlined the current tax rates of the taxing authorities and stated with the annexation of PJC, that the citizens of Paris would be paying almost 8 cents less in property taxes. Mayor Hashmi suggested that out of the eight cents decrease, they look at adding five cents of that eight cents to City tax which would mean that the citizen's taxes would still be lower than their current rate and at the same time it would allow redoing streets in Paris. He explained this five cents would generate almost 11 million dollars in revenue that could be used for streets, yet citizens would still be paying less in property taxes than they currently pay. Mayor Hashmi said he would like to hear from citizens and asked that the item be placed on the next agenda. He said if citizens were for this, he would be in favor of issuing certificates of obligation but if they had mixed feelings about it, he would be in favor of putting it on a ballot. Mayor Hashmi said if citizens were against this, then he did not want to do anything. Council Members each expressed a desire to receive input from citizens. Mayor Hashmi asked this item be placed on the next agenda to receive input from citizens. 18. Continue the public hearing, discuss and act on an ORDINANCE NO. 2016 -038: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE LOTS 8A AND 12, CITY BLOCK 262, BEING LOCATED AT 1240 N.E. 20TH STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS, FROM A SINGLE - FAMILY DWELLING DISTRICT (SF -2) TO A MULTI - FAMILY DWELLING DISTRICT (MF -2); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. A Motion to bring this item from the table was made by Mayor Hashmi and seconded by Council Member Drake. Motion carried, 7 ayes — 0 nays. Mr. Efrussy explained this zoning case was heard by Planning and Zoning in November and they voted 4 -1, in favor of recommending approval to City Council. He also said a written Regular Council Meeting December 12, 2016 Page 5 protest had been received. He said the applicants were proposing to establish duplex or apartment uses on this property. Mayor Hashmi continued the public hearing and asked for anyone wishing to speak in support or opposition, to please come forward. Chad Stephens, 3935 Miranda, he said his parents had owned this property for over 40 years, it was under contract pending a zoning change, that the change would make improvements in the neighborhood, that Hamilton Properties planned to invest 5 million dollars in Paris or Waxahachie. Jeff Hill, 480 Airport Road, he said several citizens signed the petition but when they saw pictures of the proposed property they changed their minds. He said 8 people wanted to remove their names from the petition, because they signed without knowing all of the facts. Steve Key, 2602 Lamar Ave., Apt. A, he said the P &Z process was good and he was in support of this zoning change. Jim Bell, he said they needed to look at Hillcrest, because it was a bowl. He also said he owned and managed property there and because of the flooding, the engineer needed to get the water going west. Mr. Bell said the drainage ditch had not been cleaned out in a long time. Jim Montgomery, he said he lived 100 feet from the property and safety was the main issue, citing you can't have outlets on curves. He spoke for Ms. Long, who was also against the zoning change. Cindy Thorns, 1255 22nd N.E., she opposed the zoning change because of the water drainage problems and safety reasons. Virginia Allen, 1240 -22n NE, she asked Council to deny the zoning change and urged them to get out and walk the property, so they could see the drainage problems. Deborah Chambers, 1325 22nd NE, she said there had been flooding in her home, she had paid taxes since 1976 and the property owners needed consideration. Bobby Smallwood, 3116 Stillhouse Road, he supported the zoning change and said he believed the city and engineers would require proper drainage. Sandra Hill, 1235 NE 24th Street, she said initially there was a small ditch behind her house and each year it had become bigger, and now there was a big hole. Virginia Allen, she said she had water up to her knees when it flooded. Michael Glatfelter, he said if Hamilton Properties wanted to build here that the City had won the lottery. Cecil Ballard, 1130 -20th NE, he said he was a general contractor and he would like growth but not in this neighborhood because of drainage problems and safety issues. He asked Council to consider the homeowners. Robert Woodby, he said he was Jerry Bob Stephen's brother -in -law and if Jerry Bob told them something that he would make good on his word. He said a good engineer could take care of any drainage issues. Janice Woodby spoke in support of this zoning change. Adelphia Faskens, 920 NE 20th, she supported the zoning change and said she had family living with her because there were no available rental properties. Pat Murphy, 5295 Clarksville Street, he said that he understood the homeowners' concerns but the current issues were the drainage problems, and that the first 13 houses were in the flood plain. He also said in they could alleviate future drainage problems through a site plan and retention ponds. George Stephens, he said Jerry Bob Stephens was his brother and that Jerry Bob would not do anything to jeopardize these wonderful people. Chad Stephens addressed concerns of the homeowners and said they had been in touch with the Giffords who had agreed to sell property to them to allow two entrances. He also said there were other apartments and hotels close to neighborhoods. With no one else speaking, Mayor Hashmi closed the public hearing. Regular Council Meeting December 12, 2016 Page 6 Mayor Hashmi said whether the Council votes to approve this zoning change request or not, that the City needed to make a priority to address the drainage and flooding issues in this neighborhood. Council Member Lancaster said there had been a drainage problem in this neighborhood for a long time and it needed to be addressed. Council Member Jenkins said he was for development and the concern he had was about safety. Council Member Trenado inquired if the proposed complex was for low income and Chad Stephens said it was not. Mr. Stephens added that they realized there was a flood plain and that would be addressed in the site plan. Council Member Clifford said he had sympathy with people who were having drainage issues and that needed to be addressed. He also said growth was needed in the City. Council Member Frierson said his concern was about safety. City Manager John Godwin said the applicant was pursuing the purchase of additional property for ingress and egress. Council Member Drake said she was not against growth, but these citizens were in her district and taking their concerns into consideration, that she could not vote for this zoning change. She said she had walked the neighborhood and seen the drainage problems. Planning Director Alan Efrussy suggested rezoning the property to a planned development zoning and then they would have legal requirements that would address concerns. Mayor Hashmi made a Motion to follow Mr. Efrussy's recommendation. Mr. Efrussy said it would take a month or so to accomplish this, because it would have to go through Planning and Zoning. Mayor Hashmi inquired of Chad Stephens if they would lose the buyers and Mr. Stephens answered in the affirmative, citing this had to done by January 1. Mayor Hashmi amended his Motion to approve the zoning change, which was seconded by Council Member Trenado. Motion carried, 6 ayes — 1 nay, with Council Member Drake casting the dissenting vote. 19. Conduct a public hearing, discuss and act on ORDINANCE NO. 2016 -039: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE LOTS 18 & 19, CITY BLOCK 259, BEING LOCATED AT 610 N.E. 25' STREET, IN THE CITY OF PARIS, LAMAR COUNTY, TEXAS, FROM A SPLIT ZONING OF SINGLE- FAMILY DWELLING DISTRICT NO. 2 (SF -2) AND MULTIPLE - FAMILY DWELLING DISTRICT NO. 1 (MF -1), TO A SINGLE ZONING OF MULTIPLE - FAMILY DWELLING DISTRICT NO. 1 (MF -1); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Efrussy said the applicant requested a zoning change from a split zoning of Single Family & Multiple Family Dwelling District to a single zoning of Multiple Family Dwelling District. He also said the Planning & Zoning Commission recommended approval, as did staff. Mayor Hashmi opened the public hearing and asked for anyone wishing to speak in support or opposition of this item, to please come forward. With no one speaking, Mayor Hashmi closed the public hearing. Regular Council Meeting December 12, 2016 Page 7 A Motion to approve this item was made by Council Member Frierson and seconded by Mayor Hashmi. Motion carried, 7 ayes — 0 nays. 20. Discussion on theft problem and sale of stolen property within the City of Paris. Council Member Lancaster said people were getting their business doors kicked in and property taken and then being sold to people with other shops. She explained about having a person approach her to purchase a mirror that she had seen the day before at an antique store, and that it had been stolen. She said she knew there was a State Law that required persons who were selling items to keep some type of log reflecting items they purchase from people, who they bought if from and identification of the person they bought it from. Council Member Lancaster said that the State Law was similar to the one that regulated pawn shops. Chief Hundley said the theft statute covered under the Penal Code provided a presumption of theft if you were a second hand dealer and you purchased property. He reported they had contacted businesses that sold second hand items and would continue to do so by informing them that the statute existed and they were putting themselves at risk by not asking for identification. Chief Hundley said they were going to do a better job of educating downtown property owners. He also said there were cities that had an active ordinance that included second hand shops to require a log so then the officers could review the logs when they were investigating thefts. 21. Discussion and possible action on the City of Paris' requirement of natural gas service inspections and acceptance of inspections by Atmos Energy after 90 days of no service. Mayor Hashmi said he was in favor of whatever could be legally done to make it easier for the residents of Paris. Carla Easton and Jerry McDaniel gave a presentation on the current process of gas test and inspections. Ms. Easton explained for Atmos customers who had discontinued gas service for 90 days, they were required to have a gas pressure test and inspection before the service could be reconnected. After hearing the presentation, Mr. Flowers said the power point reflects that Atmos doesn't perform any inspections of the piping or appliances and that was incorrect information, because he had gone out and seen them perform the functions. Mr. McDaniel said Mr. Flowers was correct, and the City should have been doing it. Council Member Clifford said this requirement was creating hardships for the residents of Paris. A Motion to change the requirement from ninety days to one year for a gas inspection by a plumber once the gas has been turned off at a residence, was made by Mayor Hashmi and seconded by Council Member Clifford. Motion carried, 7 ayes — 0 nays. 22. Receive status update on the installation of security cameras in the Downtown area from the Police Chief. Regular Council Meeting December 12, 2016 Page 8 Council Member Lancaster said she placed this item on the agenda and wanted to know the status. Chief Hundley reported the City had received quotes from two companies and the technology committee met last week. He said they were ready to proceed and had been working with legal to resolve a few issues but was confident the cameras would be installed by the end of January. 23. Discuss construction of an airport hangar and provide direction to staff. Airport Manager Jerry Ritchey said Federal grant funds were awarded to construct a T- Hangar and access taxiway at Cox Field and there were available funds in the amount of $1,106,666, including a 10% match. He also said the City received bids and the lowest one was for a 4 -unit option. Mr. Ritchey said the City would be responsible for additional costs over the available grant funds and that the Airport Board had requested consideration of funding the additional $433,806 in order to construct a 10 -unit hangar. Mr. Ritchey said the last time hangars were built was around 1999 and additional hangars were needed. Mayor Hashmi questioned why the City would spend $500,000 when they only rent hangars for $150.00. Council Member Drake agreed that they needed more hangars but questioned where they were going to get the money. Council Member Clifford said they were not charging enough for hangars as reflected by supply and demand. Mr. Ritchey said they had not increased the hangar rent in 16 years. Following additional discussion, no direction was given by City Council. 24. Discuss and act on ORDINANCE NO. 2016 -040: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ISSUING A LICENSE TO DAVID THOMPSON d/b /a LONE STAR CAB COMPANY TO OPERATE A TAXICAB BUSINESS ON THE PUBLIC STREETS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID LICENSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. A Motion to combine items 24, 25 and 26 was made by Mayor Hashmi and seconded by Council Member Trenado. Motion carried, 7 ayes — 0 nays. Mayor Hashmi confirmed with Mr. Godwin that these were the annual taxi cab licenses. A Motion to approve items 24, 25, and 26 was made by Mayor Hashmi and seconded by Council Member Drake. Discuss and act on ORDINANCE NO. 2016 -041: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ISSUING A LICENSE TO TRANSPORTATION PROVIDERS, LLC, d/b /a CITY CAB, TO OPERATE A TAXICAB BUSINESS ON THE PUBLIC STREETS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID LICENSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Discuss and act on ORDINANCE NO. 2016 -042: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, ISSUING A LICENSE TO RANEY DAY ENTERPRISES, INC., d/b /a YELLOW CAB, TO OPERATE A TAXICAB BUSINESS ON THE PUBLIC STREETS OF THE CITY OF PARIS, TEXAS; FINDING A PUBLIC NECESSITY AND CONVENIENCE FOR ISSUANCE OF SAID LICENSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. 27. Discuss and act on ORDINANCE NO. 2016 -043: AN ORDINANCE OF THE CITY OF PARIS, TEXAS, AMENDING ARTICLE V TO CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; PROVIDING FOR PROHIBITING LOUD AND RAUCOUS NOISES WHICH ARE DEEMED OFFENSIVE TO PERSONS OF ORDINARY SENSIBILITIES; PROVIDING FOR A PENALTY NOT TO EXCEED $500,00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. City Attorney Stephanie Harris explained this code had not been updated since the 1970's and the revisions to the ordinance would give the public greater notice of what constitutes a noise violation and would make the violations easier to prosecute. A Motion to approve this item was made by Council Member Drake and seconded by Council Member Lancaster. Motion carried, 7 ayes — 0 nays. 28. Discuss development practices and procedures. A Motion to table this item to the next City Council meeting was made by Mayor Hashmi and seconded by Council Member Drake. Motion carried, 7 ayes — 0 nays. 29. Discuss and act on naming of the street located at North Main and Campbell Soup entrance. Mayor Hashmi stated that Marvin Gibbs had made many contributions to the community. A Motion to name the street "Marvin Gibbs Blvd." was made by Mayor Hashmi and seconded by Council Member Drake. Motion carried, 7 ayes — 0 nays. 30. Discuss and act on RESOLUTION NO. 2016 -037: A RESOLUTION APPROVING THE PRIVATE RE -SALE OF MULTIPLE TRACTS OF TAX FORECLOSED PROPERTIES, AND AUTHORIZING THE MAYOR TO EXECUTE DEEDS. Mayor Hashmi recused himself citing a conflict. Mr. Godwin said this was the private re -sale of multiple tracts of tax foreclosed properties that the City had been doing with Tracy Pounders over the past six months. He also said these properties had come up for sale, there was an interested buyer, and the City wanted to go ahead and get them back on the tax roll. Regular Council Meeting December 12, 2016 Page 10 A Motion to approve this item was made by Council Member Clifford and seconded by Council Member Trenado. Motion carried, 6 ayes — 0 nays. 31. Convene into Executive Session pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about pending or contemplated litigation and/or on matters in which the duty of an attorney to his client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, clearly conflict with this chapter, as follows: First National Bank Building, 104 Bonham Street. Mayor Hashmi convened City Council into executive session at 7:58 p.m. 32. Reconvene into Open Session and possibly take action on those matters discussed in Executive Session. Mayor Hashmi reconvened City Council into open session at 8:27 p.m. He said they heard from the city attorney about the First National Bank Building at 104 Bonham Street. A Motion to have the city manager hire a structural engineer to inspect the First National Bank Building and report back to the City Council was made by Mayor Hashmi and seconded by Council Member Clifford.
