ORDINANCE NO. 99-088
AN ORDINANCE CONTAINING A HEARING ON PROPERTIES LOCATED IN
THE CITY OF PARIS, PARIS, TEXAS, BELONGING TO VARIOUS OWNERS, AND AN
ORDINANCE OF THE CITY COUNCIL FINDING THE MATERIALS REMAINING ON
THE PREMISES TO CONSTITUTE A NUISANCE AND TO BE A FIRE HAZARD TO
LIFE AND PROPERTY AND A HAZARD TO THE LIFE AND WELFARE OF THE
INHABIT ANTS OF THE AREA, AND ORDERING SAID RUBBISH, LUMBER, AND
REFUSE FROM THE STRUCTURES TO BE TORN DOWN AND REMOVED FROM THE
PREMISES IN ORDER TO ABATE SUCH NUISANCE; MAKING OTHER FINDINGS
AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE
DATE OF JANUARY 1, 1999.
WHEREAS, a public hearing was called to order by the Mayor of the City of Paris,
Charles H. Neeley, on the 9th day of December, 1999, at 6:00 o'clock p.m., in the Council
Room, City Hall, 135 1st Street S,E., in the city of Paris, Texas; and,
WHEREAS, the City Council finds that the Building Hazard Inspection Committee fixed
a date for hearing on the resolution referred to the Committee by the City Council on the 18th day
of October, 1999; that said Committee fIxed said hearing at 10:00 o'clock a.m. on the 12th day
of November, 1999, and the hearing was had thereon; and that proper notice was given to the
owner or owners of the structures located at the following addresses:

WHEREAS, that at said hearing, the Committee listed the structures involved and
introduced pictures of the various portions of the structures and various portions of the premises
involved and a list of discrepancies in the structures located thereon; that the Committee found that
each of the above structures was in such state of deterioration and dilapidation as to create a
serious fire hazard to life and property and that each of said buildings was dilapidated and was
dangerous to life and property and that each of said buildings were dangerous structures to life and
property; that said buildings are in such a state of dilapidation and decay that none of said
structures are capable of repair; that the condition of the premises and structures involved is such
that the Committee recommended to the City Council that they be declared a nuisance and that the
owners thereof be ordered by the City Council to tear down and remove the same from the lots
involved; and that said Committee fIled a complete report of its hearing and its fIndings with the
City Clerk of the City of Paris on the 16th day of November, 1999; and,
WHEREAS, the City Council further finds that proper notice was given to the owner or
owners of the structures hereinafter listed; that, at said hearing on the 12th day of November,
1999, the Committee listed the structures involved and introduced pictures of the various portions
of the structures and various portions of the premises involved and a list of discrepancies in the
structures located thereon; that the Committee found that each of the hereinafter listed structures
was in such a state of deterioration and dilapidation as to create a serious fIre hazard to life and
property, and that each of said buildings was dilapidated and dangerous to life and property and
that each of said buildings were dangerous structures to life and property; that the owners of the
property appeared before the Committee and requested time to repair the structures or the
Committee found that the structures could be repaired; and that it was the recommendation of the
Committee that the structures be condemned or repaired and that the respective owners thereof be
given the time to abate said nuisance by repair or removal as is set out in connection with each of
such addresses, as follows:

and it is so stated in the report of the Building Hazard Inspection Committee filed with the City
Clerk of the City of Paris on the 16th day of November, 1999; and,
WHEREAS, the City Council has fully heard and considered the testimony presented upon
the hearing and a complete transcript of the testimony reported by the Building Hazard Inspection
Committee; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the fIndings set out in the preamble of this ordinance are hereby in all
things approved.
Section 2. That the structures located at the following addresses:

are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and
property, and that the same constitute a fIre hazard to life and property, and that the respective
owners are hereby ordered to abate such nuisance within thirty (30) days from the date hereof.
That the structure located at the following address:
2708 18th Street N.W., Lot 18, City Block 297
is a nuisance, and it is hereby declared a nuisance, in that it is dangerous to life and property, and
that the same constitutes a fire hazard to life and property, and that the respective owner is hereby
ordered to abate such nuisance within sixty (60) days from the date hereof, That the structures
located at the following addresses:
1237 9th Street N.W., Lot 19, Block I, Elliot Addition
987 VanZandt, Lot 5, City Block 174
are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and
property, and that the same constitute a fire hazard to life and property, and that the respective
owners are hereby ordered to abate such nuisance within ninety (90) days from the date hereof.
That the structures located at the following addresses:
401 4th Street N.W., Lot 4-A City Block 54
425 4th Street N. W., Lot 4, City Block 54
are a nuisance, and they are hereby declared a nuisance, in that they are dangerous to life and
property, and that the same constitute a fIre hazard to life and property, and that the respective
owners are hereby ordered to abate such nuisance within one hundred twenty (120) days from the
date hereof. The City Clerk is directed to furnish the owners a copy of this ordinance in the event
the addresses of said owners are known, and, in the event the respective owners refuse to comply
with this ordinance, the City Attorney, Larry W, Schenk, is hereby directed to proceed to enforce
this ordinance by the procedure provided in Article III of Chapter 7 of the Code of Ordinances of
the City of Paris.
Section 3. That the structures hereinafter enumerated are a nuisance, and they are hereby
declared a nuisance, in that they are dangerous to life and property, and that the same constitute
a fIre hazard to life and property, and that the respective owners are hereby ordered to abate such
nuisances on or before the dates set out in connection with the addresses of each of such
structures, as follows:

Section 4. That the City Clerk is directed to furnish the owners a copy of this ordinance
in the event the addresses of said owners are known, and, in the event the respective owners refuse
to comply with this ordinance, the City Attorney, Larry W. Schenk, is hereby directed to proceed
to enforce this ordinance by the procedure provided in Article III of Chapter 7 of the Code of
Ordinances of the City of Paris,
Section 5. That this ordinance shall be effective January 1, 1999.
