ORDINANCE NO. 99-087 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, ADOPTING A MUNICIPAL ANNEXATION PLAN IN ACCORDANCE WITH STATE LAW; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 43.052 of the Local Government Code, as amended by Chapter 1167, Statutes of the 76th Legislative Session, also known as Senate Bill 89, 76th Texas Legislature, requires all municipalities to adopt an annexation plan in conformance with Subchapter C, Chapter 43 of the Local Government Code; and, WHEREAS, the purpose of the adoption of the aforesaid annexation plan is to designate future annexations of property appropriate for such designation, said annexations to be complete within a three year period following the adoption of the annexation plan; and, WHEREAS, the City Council of the City of Paris has previously appointed an Annexation Committee to review and familiarize itself with the new requirements of the state statutes regarding annexation; and, WHEREAS, the aforesaid Annexation Committee has reviewed the new legislation affecting annexations and has concluded and recommended that no properties be included in the annexation plan because no properties required by State Law to be included in said plan were identified for future possible annexation within the aforesaid three-year period; and, WHEREAS, although the Annexation Committee did not identify properties required for inclusion in said annexation plan, such failure to designate properties does not mean that other properties not required to be placed in said annexation plan could not be considered for annexation by the City in the future; and, WHEREAS, the Annexation Committee acknowledged that future annexations could occur without the necessity of placing said properties in the annexation plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That, from and after the day of adoption of this ordinance, this ordinance shall be hereafter referred to as the City of Paris Municipal Annexation Plan for purposes of compliance with the requirements of Chapter 43, Subchapter C, Section 43.052 of the Local Government Code regarding the adoption of a municipal annexation plan when annexations of property not subject to exemption from inclusion in a municipal annexation plan are considered by the City.
