1999-055-ORD PROVIDING ORDINANCE NO 98-069 PASSED AND ADOPTED ON THE 28TH DAY OF DECEMBER 1998 BE AMENDED BY REVISING PREAMBLE AND SECTIONS 1 AND 4 OF SAID ORDINANCE ORDINANCE NO. 99-055 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT ORDINANCE NO. 98-069, PASSED AND ADOPTED ON THE 28TH DAY DECEMBER, 1998, BE AMENDED BY REVISING THE PREAMBLE AND SECTIONS 1 AND 4 OF SAID ORDINANCE; PROVIDING THAT PROPERTIES WHICH WERE DIVIDED BETWEEN THE CITY OF PARIS AND THE CITY OF RENO BE DISANNEXED IN THEIR ENTIRETY; EXTENDING THE DEADLINE BY WHICH THE CITY OF RENO MUST ANNEX PROPERTIES DISANNEXED BY THE CITY OF PARIS; REPEALING ALL ORDINANCE OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 9, 1999. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That the preamble and Sections 1 and 4 of Ordinance No. 98-069 of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, SEPARATING, DISANNEXING, REMOVING, AND EXCLUDING FROM THE INCORPORATED AREA OF THE CITY OF PARIS, IN ACCORDANCE WITH THE TERMS OF THE COMPROMISE SETTLEMENT & RELEASE OF ALL CLAIMS IN CAUSE NO.64933, STYLED THE CITY OF RENO, TEXAS VS. THE CITY OF PARIS, TEXAS, AN AREA EMBRACING APPROXIMATELY 349.128 ACRES, MORE OR LESS, OF PROPERTY, SAID PROPERTY BEING HEREAFTER DESCRIBED BY METES AND BOUNDS; CHANGING THE BOUNDARIES OF DISTRICT 7 OF THE CITY OF PARIS SO AS TO EXCLUDE THE HEREINAFTER DESCRIBED PROPERTY mEREFROM; INSTRUCTING THE CITY ENGINEER TO AMEND THE OFFICIAL CITY LIMITS MAP AND THE VOTING DISTRICT MAP IN ACCORDANCE HEREWITH; PROVIDING FOR THE INCLUSION OF SAID AREA INTO THE CITY'S EXTRA TERRITORIAL JURISDICTION IN THE EVENT THE CITY OF RENO FAILS TO ANNEX THE SAME; AND PROVIDING FOR AN EFFECTIVE DATE OF DECEMBER 28, 1998. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That, in accordance with the terms of the Compromise Settlement & Release of All Claims in Cause No.64933, styled The City of Reno, Texas vs. The City of Paris, Texas, the following described land and territory -1- presently located within the corporate limits of the City of Paris, Paris, Texas, be, and the same is hereby, separated, disannexed, removed, and excluded from the corporate area of said City, and the boundary limits of said City are hereby altered and amended so as to exclude said territory from the corporate limits of the City of Paris, Paris, Texas, to-wit: TRACT 1 BEGINNING at a point, said point being in the existing Paris City Limit Line as described in Ordinance No. 97-059 and the existing Reno City Limit Line and being the most westerly southwest corner of the Twin Lakes Subdivision and the northwest corner of a 14.5 acre tract of land described in a deed from Charley A. Smith et ux to Danny L. Smith ; THENCE South along the west boundary line of said Smith tract a distance of 734.5 feet, more or less, to the north right-of- way line of County Road 42350 (Smallwood Road); THENCE East along the north right-of-way line of Smallwood Road a distance of 1,641.7 feet, more or less, to a point in the existing Paris City Limit Line as described in Ordinance No. 97-059 and the existing Reno City Limit Line and being the southeast corner of a 7 acre tract of land conveyed Don A. Ensey by deed recorded in Volume 667, Page 69, Real Property Records, Lamar County, Texas; THENCE North along said Paris and Reno City Limit Lines and the east boundary line of said Ensey tract a distance of 734.5 feet, more or less, to the northeast corner of said tract; THENCE West along the north boundary line of said Ensey tract and the south boundary line of the Twin Lakes Subdivision a distance of 1,641.7 feet, more or less, to the point of beginning, containing 22.286 acres, more or less, the property described herein being a 14.5 acre tract of land described in deed to Danny L. Ensey by deed recorded in Volume 667, Page 69, Real Property Records, Lamar County, Texas. -2- TRACT 2 BEGINNING at a point in the existing Paris City Limit Line as described in Ordinance No. 97-059, said point being the southwest corner of an 11.622 acre tract of land conveyed Porter Smallwood, Jr. by deed recorded in Volume 545, Page 29, Deed Records, Lamar County, Texas, said point also being the intersection of the north right-of-way line of County Road 42350 (Smallwood Road) and the east right-of-way line of 36th Street N.E.; THENCE east along the existing Paris City Limit Line and the north right-of-way line of Smallwood Road a distance of 660 feet, more or less, to the southeast corner of said Smallwood tract and the southwest corner of a 14.5 acre tract of land described in deed from Charley A. That, if the above-described territory has not been annexed into the City of Reno prior to December 1, 1999, the same shall become subject to the extraterritorial jurisdiction of the City of Paris.
