ORDINANCE NO. 99-073 AN ORDINANCE ESTABLISHING A MAXIMUM RATE OF SPEED ON US 82 IN THE CORPORATE LIMITS OF PARIS, LAMAR COUNTY, TEXAS, DURING THE TEXAS DEPARTMENT OF TRANSPORTATION'S WIDENING PROJECT #NH 2000 (164); PROVIDING FOR A FINE NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. No person shall ever drive a vehicle on US 82 in the city of Paris, Texas, at a speed greater than is reasonable and prudent under the conditions and circumstances during said project. Except when a special hazard exists that requires lower speeds for compliance with the above requirements, the limits hereinafter set out shall be lawful, but any speed in excess of the limits as hereinafter set out for US 82 and portions thereof to which they apply shall be prima facie evidence that the speed is not reasonable or prudent: On US 82, in the corporate limits of Paris, Lamar County, Texas, a distance of approximately 0.3950 miles, beginning 0.817 miles west of reference marker 712 and ending 0.422 miles west of reference marker 712, a speed limit of forty-fIve (45) miles per hour during construction phase of said project. Section 2. Any person violating any of the provision of this ordinance shall be guilty of a misdemeanor, and, upon conviction thereof shall be fined in any sum not to exceed $200.00. Section 3. All ordinances or parts of ordinances- which conflict with this ordinance herewith are hereby expressly repealed. Section 4. The fact that present traffic regulations are inadequate to control traffic in areas covered by this ordinance creates an emergency which is here and now declared, and all rules and regulations providing for the reading of ordinances are suspended and this ordinance is passed as an emergency measure and shall be in full force and effect until completion of said project is reached.
