<br />ORDINANCE NO. 99-073 <br /> <br />AN ORDINANCE ESTABLISHING A MAXIMUM RATE OF SPEED ON US 82 IN <br />THE CORPORATE LIMITS OF PARIS, LAMAR COUNTY, TEXAS, DURING THE <br />TEXAS DEPARTMENT OF TRANSPORTATION'S WIDENING PROJECT #NH 2000 <br />(164); PROVIDING FOR A FINE NOT TO EXCEED $200.00; REPEALING ALL <br />ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND <br />DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br /> <br />Section 1. No person shall ever drive a vehicle on US 82 in the city of Paris, Texas, at <br />a speed greater than is reasonable and prudent under the conditions and circumstances during said <br />project. Except when a special hazard exists that requires lower speeds for compliance with the <br />above requirements, the limits hereinafter set out shall be lawful, but any speed in excess of the <br />limits as hereinafter set out for US 82 and portions thereof to which they apply shall be prima facie <br />evidence that the speed is not reasonable or prudent: <br /> <br />On US 82, in the corporate limits of Paris, Lamar County, Texas, a distance of <br />approximately 0.3950 miles, beginning 0.817 miles west of reference marker 712 <br />and ending 0.422 miles west of reference marker 712, a speed limit of forty-fIve <br />(45) miles per hour during construction phase of said project. <br /> <br />Section 2. Any person violating any of the provision of this ordinance shall be guilty of <br />a misdemeanor, and, upon conviction thereof shall be fined in any sum not to exceed $200.00. <br /> <br />Section 3. All ordinances or parts of ordinances- which conflict with this ordinance <br />herewith are hereby expressly repealed. <br /> <br />Section 4. The fact that present traffic regulations are inadequate to control traffic in areas <br />covered by this ordinance creates an emergency which is here and now declared, and all rules and <br />regulations providing for the reading of ordinances are suspended and this ordinance is passed as <br />an emergency measure and shall be in full force and effect until completion of said project is <br />reached. <br /> <br />PASSED AND ADOPTED this 11th day of October, 1999. <br /> <br />
