ORDINANCE NO. 99-033
AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT
THE CODE OF ORDINANCES OF THE CITY OF PARIS BE AMENDED BY ADDING
ARTICLE X TO CHAPTER TWO, SECTIONS 2-500 THROUGH 2-549; ESTABLISHING
AN ORDINANCE COMMISSION; AND PROVIDING FOR AN EFFECTIVE DATE OF
APRIL 12, 1999.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
Section 1. That the Code of Ordinances of the City of Paris, Paris, Texas, be amended by
adding Article X to Chapter Two, Sections 2-500 through 2-549, establishing an Ordinance
Commission, to read as follows:
"ARTICLE X
"ORDINANCE COMMISSION
"Sec. 2-500. Created; composition.
"There is hereby created and established within and for the City an Ordinance
Commission, composed of seven (7) members, whose offices are hereby created.
"Sec. 2-501. Qualifications and appointment of members.
"The members of the Ordinance Commission shall be resident citizens and
qualified voters of the City, all of whom shall be appointed by the Mayor with the
advice and consent of the Council. Regular appointment of members shall be made
on the first regular Council meeting in June of each year.
"Sec. 2-502. Terms of members; filling vacancies.
"Members of the Ordinance Commission shall be appointed to serve for terms
of two (2) years. All vacancies shall be filled by appointment by the Mayor with the
advice and consent of the Council as soon as practical.
"Sec. 2-503. Members to serve without compensation.
"The members of the Ordinance Commission shall serve without
compensation.
"Sec. 2-504. Selection of Chairperson.
"The chairperson of the Ordinance Commission shall be selected on the first
regular meeting in July of each year by the members of the Commission. A member
may serve consecutive terms as the chairperson.
"Sec. 2-505. General powers and duties.
"The Ordinance Commission shall have the following power and it shall be its
duty to:
"1. Consider, hold public hearings, and make studies on revisions and
amendments to the Code of Ordinances for the City of Paris;
"2. Consider, hold public hearings, and make studies on revisions and
amendments to the City Charter when and to the extent directed by the
Council;
"3. Recommend revisions and amendments to the Code of Ordinances and
the Charter to the City Council for appropriate action; and
"4. Exercise all other powers specifically conferred by the Council.
"Sec. 2-506. Time and place of meetings.
"The Ordinance Commission shall, subject to the approval of the City Council,
designate such times and places for holding meetings as it deems proper.
"Sec. 2-507. Quorum.
"Four (4) members of the Ordinance Commission shall constitute a quorum for
the transaction of business.
"Sec. 2-508. Rules, regulations and bylaws.
"The Ordinance Commission shall, subject to the approval of the City Council,
make such rules and regulations and adopt such bylaws for its own government as it
deems proper.
"Sec. 2-509. Involvement of City Staff and Attorney
"( a) In the course of performing its duties established herein, the Ordinance
Commission shall request input from the department heads of each and every affected
department. Prior to making a final recommendation to the City Council concerning
individual ordinances, the Commission shall request a written report from such
department head stating the affected department's ability to enforce proposed
ordinances or amendments to existing ordinances. Communications with department
heads shall be directed through the City Manager.
"(b) Failure to comply with the provisions of subparagraph (a) shall not affect
the validity or enforceability of any ordinance or amendment to an existing ordinance
that is proposed by the Commission and passed by the City Council.
"( c) The City Attorney shall be the legal advisor to the Ordinance Commission
and shall serve as the liaison between the City Council and the Commission. He shall
also assist the Commission in coordinating its activities.
"Sec. 2-510 - 2-549. Reserved."
Section 2. All ordinances or parts of ordinances in conflict herewith are hereby expressly
repealed.
Section 3. This ordinance shall become effective on April 12, 1999.
